【摘要】：在我國全面深化改革的時代背景下,完善重大行政決策程序?qū)ν七M(jìn)依法治國方略的實(shí)施、建設(shè)法治政府具有重要意義。十八大以來,黨中央和國務(wù)院在相關(guān)文件中決定公眾參與、專家論證、風(fēng)險評估、合法性審查、集體討論決定為重大行政決策法定程序。隨著政策和法制的不斷完善,專家論證程序在重大行政決策中的地位逐漸加強(qiáng)。但是,在實(shí)踐中,重大行政決策專家論證程序仍存在著專家被政府或利益團(tuán)體雇傭、專家管見和越位、規(guī)范重大行政決策專家論證制度的缺乏、重大行政決策專家論證程序的不合理等問題,嚴(yán)重影響重大行政決策的科學(xué)性。為此,需要加強(qiáng)重大行政決策程序中專家論證問題的研究,促進(jìn)重大行政決策專家論證功能的發(fā)揮,以提升重大行政決策的效果。本文以重大行政決策程序為基礎(chǔ),借鑒國內(nèi)外的文獻(xiàn)資料,通過比較分析法與案例分析法,對重大行政決策專家論證的相關(guān)概念及理論基礎(chǔ)、存在的問題、問題出現(xiàn)的原因、對策方面進(jìn)行了分析和論述。文章首先在明確了研究的背景、目的及意義、研究的思路及方法、研究創(chuàng)新點(diǎn)的基礎(chǔ)上,對重大行政決策專家論證的相關(guān)概念進(jìn)行界定,如行政決策程序、行政決策與重大行政決策、重大行政決策專家論證。并以程序正義理論、專家理性理論作為本文的理論支撐。其次,以重大行政決策專家論證中存在的問題為研究對象,從專家被政府或利益團(tuán)體雇傭、專家管見和越位、規(guī)范重大行政決策專家論證制度的缺乏、重大行政決策專家論證程序的不合理等方面進(jìn)行了論述,并對導(dǎo)致我國重大行政決策專家論證問題出現(xiàn)的原因進(jìn)行深入剖析。研究發(fā)現(xiàn),我國傳統(tǒng)文化的負(fù)面影響、重大行政決策程序立法的缺位以及重大行政決策論證專家自身的局限性是導(dǎo)致重大行政決策專家論證問題出現(xiàn)的重要因素。最后,根據(jù)重大行政決策專家論證存在的問題分析,從加強(qiáng)行政法治文化建設(shè)、完善重大行政決策專家論證的制度建設(shè)、規(guī)范重大行政決策專家論證程序建設(shè)、提升專家的公信力以及完善立法等方面提出對策建議,從而促進(jìn)重大行政決策專家論證功能的實(shí)現(xiàn)。
[Abstract]:In the background of China's comprehensive deepening of the reform, it is of great significance to improve the major administrative decision-making procedure to promote the implementation of the rule of law and to build a government ruled by law. Since eighteen, the Party Central Committee and the State Council have decided to participate in the relevant documents, the expert argument, the assessment of the risk, the examination of the legitimacy, and the decision of the collective discussion as the major administration. With the continuous improvement of policy and legal system, the status of the expert demonstration program in major administrative decisions is gradually strengthened. However, in practice, the expert demonstration procedure still exists that experts are employed by the government or interest groups, experts are seen and offside, and the lack of expert argumentation system is standardized. The problems of the unreasonable procedure of the major administrative decision experts seriously affect the scientificalness of the major administrative decisions. Therefore, it is necessary to strengthen the research on the problem of expert demonstration in the major administrative decision-making procedure, promote the function of the demonstration of the major administrative decision experts, and improve the effect of the major administrative decision. This paper is based on the major administrative decision-making procedure. On the basis of the literature at home and abroad, through the comparative analysis and case analysis, the relevant concepts and theoretical bases of the argument of the major administrative decision experts, the existing problems, the reasons for the problems and the countermeasures are analyzed and discussed. The article first clarifies the background, purpose and significance of the research, and the thinking and prescription of the research. On the basis of the research innovation point, it defines the relevant concepts of the argument of the major administrative decision experts, such as the administrative decision procedure, the administrative decision and the major administrative decision, the demonstration of the experts in the major administrative decision, and the theoretical support of the procedural justice theory and the expert rational theory. The problem is the research object, the expert is employed by the government or the interest group, the expert is seen and offside, the lack of the expert argumentation system of the major administrative decision-making, the unreasonable aspects of the demonstration procedure of the major administrative decision experts are discussed, and the reasons for the problems that lead to the demonstration of the major administrative decision experts in China are deeply analyzed. The study finds that the negative influence of Chinese traditional culture, the absence of the major administrative decision-making procedure legislation and the limitations of the experts of major administrative decision and demonstration are the important factors that lead to the problem of the argument of the major administrative decision experts. Finally, the analysis of the existing problems in the demonstration of the major administrative decision-making experts is to strengthen the administrative rule of law. The construction of cultural construction, the improvement of the system construction of the demonstration of major administrative decision-making experts, the standardization of the construction of the procedure for demonstration of experts in major administrative decision-making, the promotion of the credibility of experts and the improvement of legislation are put forward in order to promote the realization of the function of the demonstration of the experts in major administrative decisions.
