完善我國(guó)建設(shè)工程款支付保障制度研究

【摘要】:建筑業(yè)作為國(guó)民經(jīng)濟(jì)的支柱產(chǎn)業(yè),關(guān)系著人們生活水平的提高、國(guó)民經(jīng)濟(jì)的穩(wěn)定健康發(fā)展。但是建設(shè)工程款支付過程中的拖欠問題卻是阻礙建筑業(yè)健康發(fā)展的頑疾,它不僅影響建筑企業(yè)自身壯大,阻礙社會(huì)信用體系建立的進(jìn)程,而且建設(shè)工程款久拖不決勢(shì)必會(huì)影響到農(nóng)民工工資的正常發(fā)放,不利于社會(huì)主義和諧社會(huì)的建立。為此,政府部門陸續(xù)頒布了一系列政策、采取了一些行政手段,雖在短期內(nèi)取得了一些成效,但只是治標(biāo)不治本。工程款拖欠問題產(chǎn)生的根源在于我國(guó)現(xiàn)有的工程款支付保障措施存在缺陷。目前我國(guó)主要的保障措施包括:建設(shè)項(xiàng)目資金落實(shí)相關(guān)規(guī)定、工程款支付相關(guān)規(guī)定、建設(shè)工程優(yōu)先受償權(quán)制度以及業(yè)主支付擔(dān)保制度,但是由于它們存在缺陷或不足而執(zhí)行效果不佳。在建設(shè)項(xiàng)目資金落實(shí)這一規(guī)定中,沒有明確資金落實(shí)的具體標(biāo)準(zhǔn)和違反該規(guī)定的法律后果,導(dǎo)致行政監(jiān)管出現(xiàn)漏洞。對(duì)工程款支付相關(guān)規(guī)定比較詳細(xì)的《建設(shè)工程價(jià)款結(jié)算暫行辦法》因法律位階太低而執(zhí)行不暢,而位階較高的《中華人民共和國(guó)建筑法》(下稱《建筑法》)以及《中華人民共和國(guó)合同法》(下稱《合同法》)對(duì)此規(guī)定得比較粗糙,操作性不強(qiáng)。我國(guó)《合同法》第二百八十六條確定了建設(shè)工程優(yōu)先受償權(quán)制度,但是并有明確優(yōu)先權(quán)的性質(zhì),在理論界引發(fā)了一系列爭(zhēng)議;另外,對(duì)于該制度規(guī)定得比較原則,雖然后來最高人民法院出臺(tái)了司法解釋對(duì)該制度進(jìn)行了細(xì)化,但是并未形成一個(gè)完整體系,且司法解釋本身存在一些不盡合理之處,大大影響了該制度功能的發(fā)揮。而對(duì)于業(yè)主支付擔(dān)保制度,雖然國(guó)家近年來大力提倡,但是只是散見于一些政策文件中,并沒有形成法律的強(qiáng)制性規(guī)定,執(zhí)行效果有限。因此,有必要在充分借鑒、吸收域外各國(guó)關(guān)于工程款支付保障制度有益經(jīng)驗(yàn)的基礎(chǔ)上,進(jìn)一步完善我國(guó)建設(shè)工程支付保障體系,最終實(shí)現(xiàn)對(duì)工程款拖欠問題標(biāo)本兼治的目的。
[Abstract]:As the pillar industry of the national economy, the construction industry is related to the improvement of people's living standard and the steady and healthy development of the national economy. However, the problem of arrears in the process of payment of construction funds is a persistent disease that hinders the healthy development of the construction industry. It not only affects the construction enterprises themselves, but also hinders the process of the establishment of the social credit system. Moreover, the delay of construction money will inevitably affect the normal distribution of migrant workers' wages, which is not conducive to the establishment of a harmonious socialist society. As a result, government departments have successively promulgated a series of policies and adopted some administrative measures. Although they have achieved some results in the short term, they have only dealt with the symptoms and not the root causes. The origin of the problem lies in the defects of the existing payment guarantee measures in our country. At present, the main safeguards in our country include: the implementation of relevant provisions on construction project funds, the relevant provisions on the payment of project funds, the system of priority payment of construction projects and the payment guarantee system of owners. However, due to their shortcomings or deficiencies, the implementation effect is not good. In the implementation of construction project funds, there are no specific standards for the implementation of funds and the legal consequences of violating the provisions, which leads to loopholes in administrative supervision. The Provisional measures for the settlement of Construction Project Price, which are relatively detailed and related to the payment of project funds, are not implemented smoothly because the legal rank is too low, On the other hand, the "Building Law of the people's Republic of China" (hereinafter referred to as the "Building Law") and the "contract Law of the people's Republic of China" (hereinafter referred to as the "contract Law") are relatively rough and not easy to operate. Article 286 of the contract Law of China establishes the system of priority compensation for construction projects, but it also has a clear nature of priority, which has caused a series of disputes in the theoretical circle. Although the Supreme people's Court later introduced a judicial interpretation to refine the system, but did not form a complete system, and there are some unreasonable judicial interpretation itself, greatly affected the function of the system. However, in recent years, the payment guarantee system is advocated by the government, but it is only scattered in some policy documents, and has not formed the mandatory provisions of the law, and the effect of enforcement is limited. Therefore, it is necessary to further improve the payment guarantee system of construction projects in our country on the basis of drawing lessons from and absorbing the beneficial experiences of foreign countries on the payment guarantee system of engineering payment, and finally achieve the purpose of treating the problem of project payment arrears at both the root and the root of the problem.
