【摘要】：法治背景下,以綜合媒體為主的傳媒群體依托其傳播方式的效用優(yōu)勢(shì)極大地實(shí)現(xiàn)對(duì)司法的監(jiān)督作用。出于對(duì)司法公允的追求,有理由將媒體納入對(duì)審判運(yùn)行的監(jiān)督程序。然而學(xué)術(shù)界以及社會(huì)公眾對(duì)此仍留有質(zhì)疑,其是否能夠達(dá)到監(jiān)督的實(shí)質(zhì)效果,如何理解現(xiàn)實(shí)中出現(xiàn)的媒體審判的論調(diào),關(guān)于其與保證司法審判獨(dú)立地運(yùn)作之間的關(guān)系爭(zhēng)論不休,認(rèn)為媒體監(jiān)督干擾了法院審判的獨(dú)立性,故而對(duì)推進(jìn)媒體監(jiān)督,建立且完善媒體監(jiān)督機(jī)制前景堪憂。須以肯定媒體對(duì)審判活動(dòng)的監(jiān)督作用為出發(fā)點(diǎn),圍繞媒體監(jiān)督與審判獨(dú)立二者之間的界定問題進(jìn)行討論,在厘清二者關(guān)系的基礎(chǔ)之上,明晰媒體的監(jiān)督主體以及媒體監(jiān)督的直接作用范疇,分析轉(zhuǎn)型期背景下我國媒體監(jiān)督的特征,主張保護(hù)和推動(dòng)媒體對(duì)審判活動(dòng)的監(jiān)督作用,另外,分析媒體審判這一觀點(diǎn)產(chǎn)生的原因,并針對(duì)相應(yīng)問題進(jìn)行不斷完善。針對(duì)我國在推進(jìn)司法改革的過程中,同步建立和發(fā)展媒體監(jiān)督機(jī)制,在分析國外處理模式的基礎(chǔ)上,將媒體監(jiān)督作用的理論依據(jù)融匯于我國現(xiàn)狀。從媒體與司法主體二者的角度分別提出設(shè)想,尋求與我國國情相對(duì)應(yīng)的媒體監(jiān)督體系,并將該系統(tǒng)的作用最大化。
[Abstract]:Under the background of the rule of law, the mass media based on the comprehensive media has greatly realized the function of supervising the judicature on the basis of the utility advantage of its means of communication. For the pursuit of judicial fairness, there is reason to bring the media into the supervision procedure of trial operation. However, the academic community and the public still have doubts about this, whether it can achieve the substantive effect of supervision, how to understand the argument of media trial in reality, and about the relationship between it and ensuring the independent operation of judicial trial. It is considered that media supervision interferes with the independence of the court, so the prospect of promoting media supervision and establishing and perfecting the media supervision mechanism is worrying. On the basis of clarifying the relationship between media supervision and judicial independence, it is necessary to discuss the definition of media supervision and judicial independence in order to confirm the role of the media in the supervision of trial activities. Clarify the main body of media supervision and the direct role of media supervision, analyze the characteristics of media supervision in the context of the transition period, advocate the protection and promotion of the role of the media in the supervision of judicial activities, in addition, Analyze the reasons of media trial, and improve the corresponding problems. In view of the establishment and development of media supervision mechanism in the process of promoting judicial reform in our country, the theoretical basis of media supervision function is integrated into the present situation of our country on the basis of analyzing the foreign processing mode. From the point of view of the media and the judicial subject, this paper proposes a media supervision system corresponding to the situation of our country, and maximizes the function of the system.
