【摘要】：延邊朝鮮族自治州(以下簡稱為"延邊州")是我國最早建立的少數(shù)民族自治地方之一,也是東北三省設(shè)立的唯一少數(shù)民族自治州,該地區(qū)朝鮮民族人口較多,是我國朝鮮民族的最大聚居地區(qū),而該州的《延邊朝鮮族自治州自治條例》是我國包括5個(gè)自治區(qū)在內(nèi)的所有民族自治地方的首部自治條例。自1985年延邊州頒布第一個(gè)條例,至今已有20余年,相對于其他民族自治地方,延邊州的自治立法有其自身的先進(jìn)性,但同時(shí)也存在一些問題。本文試圖運(yùn)用憲法學(xué)與行政法學(xué)的系統(tǒng)理論知識,對延邊朝鮮族自治州自治立法的進(jìn)行分析,在對延邊州立法特色和立法成效進(jìn)行闡述的前提下,剖析延邊州立法中存在的漏洞,提出了鞏固和改進(jìn)自治立法的客觀性建議。論文共包含五個(gè)部分,各部分間層層遞進(jìn),概括分析了延邊州的自治立法。第一部分:主要闡釋了本篇論文的選題背景、關(guān)于延邊州自治立法的研究現(xiàn)狀、論文的研究方法、研究目的和論文選題的意義。第二部分:從延邊州自治立法的歷史沿革著手,對延邊州自治立法的起步和發(fā)展分別作了闡述,主要闡明了《延邊州自治條例》和47部單行條例的制定及修改過程。第三部分:詳實(shí)客觀的分析了延邊州自治立法的成果,以圖表的形式對延邊州1985年至2016年12月的立法數(shù)量做了統(tǒng)計(jì),在此基礎(chǔ)上,又分類統(tǒng)計(jì)了所有48部條例,并對所有已做出修改的條例進(jìn)行了數(shù)據(jù)統(tǒng)計(jì),同時(shí)分析了延邊州2013—2017年的五年立法計(jì)劃(包括修改后的2015-2017年的立法計(jì)劃)及該立法計(jì)劃的完成狀況。第四部分:在對延邊州部分條例深入解讀的基礎(chǔ)上,全面分析了延邊州自治立法的特色及取得的成效。首先,延邊州自治立法注重保護(hù)民族特色,即:注重保護(hù)民族語言文字、傳承民族傳統(tǒng)文化、發(fā)展民族傳統(tǒng)體育、保護(hù)延邊州非物質(zhì)文化遺產(chǎn)。其次,延邊州自治立法注重保護(hù)天然礦泉水水源環(huán)境、人參產(chǎn)業(yè)和長柏松等地方特色資源。再次,從經(jīng)濟(jì)效應(yīng)、社會效應(yīng)和填補(bǔ)多項(xiàng)立法空白三個(gè)方面介紹了延邊州自治立法取得的成效,社會效應(yīng)包括:促進(jìn)了延邊州民族文化的發(fā)展、深化了延邊州的教育工作、加強(qiáng)了延邊州內(nèi)民族團(tuán)結(jié)。第五部分:介紹了延邊州自治立法存在的問題,即:民族特色彰顯不足,照搬上位法;條例內(nèi)容滯后,修訂不及時(shí);立法深度不夠,實(shí)效性不強(qiáng);條例中法律責(zé)任規(guī)定不明確。針對延邊州自治立法中的這些不足,提出了自己的完善建議,即:延邊州自治立法應(yīng)根植地方實(shí)際,彰顯民族特色;破除立法時(shí)注重?cái)?shù)量,輕質(zhì)量的誤區(qū);加強(qiáng)填補(bǔ)性立法,注重實(shí)效性;強(qiáng)化條例責(zé)任追究機(jī)制。
[Abstract]:Yanbian Korean Autonomous Prefecture (hereinafter referred to as "Yanbian Prefecture") is one of the earliest ethnic minority autonomous areas established in China, and the only ethnic minority autonomous prefecture established in the three northeastern provinces. Yanbian Korean Autonomous Prefecture is the largest inhabited area of the Korean nationality in China, and the Yanbian Korean Autonomous Prefecture Autonomy Ordinance is the first autonomous regulation of all ethnic autonomous areas in China, including five autonomous regions. It has been more than 20 years since the first regulation was promulgated by Yanbian prefecture in 1985. Compared with other national autonomous regions, the autonomous legislation of Yanbian prefecture has its own advanced nature, but there are also some problems at the same time. This paper attempts to analyze the autonomous legislation of Yanbian Korean Autonomous Prefecture by using the systematic theoretical knowledge of constitutional law and administrative jurisprudence, and on the premise of expounding the legislative characteristics and legislative effect of Yanbian Prefecture. This paper analyzes the loopholes in the legislation of Yanbian prefecture, and puts forward some suggestions to consolidate and improve the objectivity of the autonomous legislation. This paper consists of five parts, and analyzes the autonomous legislation of Yanbian state. The first part mainly explains the background of this thesis, the research status of Yanbian Autonomous legislation, the research methods, the purpose and the significance of the thesis. The second part: starting from the history of Yanbian autonomous legislation, this paper expounds the start and development of Yanbian autonomous legislation, mainly expounds the formulation and revision process of "Yanbian Autonomous regulations" and 47 separate regulations. The third part: detailed and objective analysis of the results of Yanbian Autonomous legislation, in the form of a chart of Yanbian Prefecture from 1985 to December 2016 legislation statistics, on the basis of this, and classified all 48 regulations. The statistics of all the revised regulations are given, and the five-year legislative plan of Yanbian state for 2013-2017 (including the revised legislative plan for 2015-2017) and the status of completion of the legislative plan are analyzed. The fourth part: on the basis of deeply interpreting some regulations of Yanbian prefecture, this paper analyzes the characteristics and achievements of Yanbian autonomous legislation. First of all, Yanbian Autonomous legislation pays attention to the protection of national characteristics, that is: pay attention to the protection of national language and characters, heritage of national traditional culture, development of traditional national sports, protection of the intangible cultural heritage of Yanbian. Secondly, Yanbian Autonomous legislation focuses on the protection of natural mineral water source environment, ginseng industry and Changbesong and other local resources. Thirdly, from the aspects of economic effect, social effect and filling up many legislative gaps, this paper introduces the achievements of Yanbian autonomous legislation, which includes: promoting the development of Yanbian nationality culture, deepening the education work of Yanbian prefecture. The unity of nationalities in Yanbian prefecture has been strengthened. The fifth part introduces the problems existing in the autonomous legislation of Yanbian Prefecture, that is: insufficient national characteristics, copying the upper law; the content of the regulations lag behind, the revision is not timely; the depth of legislation is not enough, the effectiveness is not strong; the provisions of the regulations on legal responsibility are not clear. In view of these shortcomings in Yanbian autonomous legislation, the author puts forward his own suggestions, that is: Yanbian autonomous legislation should be based on local reality, highlight national characteristics, break down the misunderstanding of quantity and light quality in legislation, strengthen the filling legislation, Pay attention to the effectiveness; strengthen the accountability mechanism of regulations.
