【摘要】：黨的十八屆三中全會于審議并通過了《中共中央關(guān)于全面深化改革若干重大問題的決定》,《決定》指出,“全面深化改革的總目標是完善和發(fā)展中國特色社會主義制度,推進國家治理體系和治理能力現(xiàn)代化�！痹趪抑卫砟芰椭卫眢w系的現(xiàn)代化中,經(jīng)濟領(lǐng)域的現(xiàn)代化至關(guān)重要。政府在市場經(jīng)濟建設(shè)中的作用主要表現(xiàn)在對于市場的監(jiān)管方面,而我國政府在市場監(jiān)管上所采用的主要手段就是行政審批,通過行政審批這一手段來對市場中的主體進行準入限制,從而保證市場的有序運轉(zhuǎn)。黨的十八屆三中全會以來,國務(wù)院對行政審批進行了大規(guī)模的精簡、取消和下放,但是我國政府和市場之間的關(guān)系難以捋順的關(guān)鍵一點在于,我國歷史上的多次改革為我們提供了一定的經(jīng)驗教訓,即“一放就亂、一亂就收、一收就死、一死就放”的惡性循環(huán),如何避免我國新一輪的市場經(jīng)濟改革和政府職能改革中出現(xiàn)這種怪圈,這就要求在政府部門“簡政放權(quán)”之后,要積極開展針對行政審批的事中事后監(jiān)管工作,從而確保我國市場經(jīng)濟的有序運行。本文采用治理理論作為文章的理論工具,首先進行了行政審批監(jiān)管的現(xiàn)狀及問題分析。其中現(xiàn)狀分析主要包括法律法規(guī)建設(shè)現(xiàn)狀,以及現(xiàn)行監(jiān)管現(xiàn)狀兩個方面。問題分析主要包括法律法規(guī)建設(shè)不完善、監(jiān)管中存在缺位和不到位的現(xiàn)象、監(jiān)管主體及主體間關(guān)系的問題、以及市場主體自身缺少責任意識這四個方面。隨后,本文當前行政審批監(jiān)管的現(xiàn)狀及其中存在的問題進行根源性分析,找出當前行政審批監(jiān)管中問題的根本原因。主要包括制度供給不足、監(jiān)督認識偏差、社會組織發(fā)育不足、以及社會信任度低這四個方面。最后,本文根據(jù)問題以及問題產(chǎn)生的根源提出了完善行政審批監(jiān)管的對策建議。主要包括完善相關(guān)法律法規(guī)、轉(zhuǎn)變監(jiān)管理念、完善多方參與主體的協(xié)調(diào)機制、以及實現(xiàn)全程監(jiān)管這四個方面。從而構(gòu)建監(jiān)管主體多元化、市場和社會共享公共權(quán)力、民眾積極參與、各主體之間信息共享、通力協(xié)作的市場監(jiān)管體系。
[Abstract]:The third Plenary session of the 18th CPC Central Committee deliberated and adopted the "decision of the CPC Central Committee on several important issues of comprehensively deepening Reform", which pointed out that "the overall goal of comprehensively deepening reform is to perfect and develop the socialist system with Chinese characteristics,"To promote the modernization of the national governance system and governance capacity. "In the modernization of national governance capacity and governance system, the modernization of economic field is very important.The role of the government in the construction of the market economy is mainly manifested in the supervision of the market, and the main means adopted by our government in market supervision is administrative examination and approval.In order to ensure the orderly operation of the market, the main body of the market is restricted by the means of administrative examination and approval.Since the third Plenary session of the 18th CPC Central Committee, the State Council has carried out large-scale streamlining, cancellation and decentralization of administrative examination and approval. However, the key point that makes it difficult to smooth the relationship between the Chinese government and the market is thatThe many reforms in our country's history have provided us with a certain experience and lesson, that is, the vicious circle of "one release is chaos, one is chaos, one is chaos, one receives death, one dies, one dies".How to avoid this kind of strange circle in the new round of market economy reform and government function reform in our country, which requires that after the government departments "devolve power", it is necessary to actively carry out the supervision work after the administrative examination and approval.So as to ensure the orderly operation of our market economy.In this paper, governance theory is used as the theoretical tool of the article, and the present situation and problems of administrative examination and approval supervision are analyzed.The present situation analysis mainly includes the current situation of the construction of laws and regulations, as well as the current situation of supervision.The problem analysis mainly includes four aspects: the imperfect construction of laws and regulations, the absence and imperfection of supervision, the problem of the relationship between the subject and the subject, and the lack of responsibility consciousness of the main body of the market itself.Then, this paper analyzes the current situation of administrative examination and approval supervision and the existing problems, and finds out the root causes of the problems in the current administrative examination and approval supervision.It mainly includes four aspects: insufficient supply of system, deviation of supervision cognition, insufficient development of social organization and low social trust.Finally, according to the problems and the root causes of the problems, this paper puts forward some countermeasures and suggestions to improve the supervision of administrative examination and approval.It mainly includes four aspects: perfecting the relevant laws and regulations, changing the concept of supervision, perfecting the coordination mechanism of multi-party participants, and realizing the whole process of supervision.In order to construct the market supervision system, the supervision body is diversified, the market and society share the public power, the people participate actively, the information is shared among the subjects, and the market supervision system is coordinated.
