【摘要】：近年來(lái),由于吸毒成本的降低和機(jī)動(dòng)車(chē)的普及,“毒駕”行為造成的交通事故呈“荷塘式效應(yīng)”的大爆發(fā)。在我國(guó)吸毒是一種違法行為,當(dāng)吸毒和駕駛機(jī)動(dòng)車(chē)結(jié)合在一起,其嚴(yán)重性是不言而喻的,“毒駕猛如虎”并不是危言聳聽(tīng)。然而現(xiàn)行與“毒駕”有關(guān)的法律都是一些宏觀(guān)性和原則性的規(guī)定,具體規(guī)定“毒駕”法律責(zé)任的法條少。行政法層面主要是從限制吸毒人員申領(lǐng)機(jī)動(dòng)車(chē)駕駛證和機(jī)動(dòng)車(chē)駕駛證的注銷(xiāo)兩方面來(lái)規(guī)制“毒駕”,并沒(méi)有對(duì)“毒駕”行為設(shè)置嚴(yán)格的懲罰措施。行政法對(duì)“毒駕”的打擊力度太小,根本不能達(dá)到震懾吸毒駕駛?cè)说哪康?僅僅依靠行政法的規(guī)制來(lái)治理日益嚴(yán)重的“毒駕”行為是行不通的�！缎谭ㄐ拚�(八)》將“酒駕”納入危險(xiǎn)駕駛罪后,人們對(duì)于和“酒駕”危險(xiǎn)性相當(dāng)?shù)摹岸抉{”入刑的呼聲日益強(qiáng)烈�！岸抉{”行為是世界各國(guó)都要面對(duì)的問(wèn)題,許多國(guó)家很早就開(kāi)始了對(duì)“毒駕”的研究,考察世界各國(guó)的做法,大部分國(guó)家都把“毒駕”納入到刑法的規(guī)制范圍,并設(shè)置嚴(yán)厲的懲罰措施。我們有必要效仿其他國(guó)家的做法將嚴(yán)重威脅公民人身財(cái)產(chǎn)安全的“毒駕”行為納入到刑法規(guī)制中,切實(shí)保障公民的人身財(cái)產(chǎn)安全。
[Abstract]:In recent years, due to the reduction of drug cost and the popularity of motor vehicles, the traffic accidents caused by "drug driving" have become "lotus pond effect".Drug abuse is a kind of illegal behavior in our country. When drug use and driving motor vehicle are combined, its seriousness is self-evident, "drug driving like tiger" is not alarmist.However, the existing laws related to "drug driving" are some macroscopic and principled provisions, and there are few provisions to specify the legal liability of "drug driving".The administrative law mainly regulates "drug driving" from two aspects: restricting drug addicts from applying for motor vehicle driving license and cancelling motor vehicle driving license, and does not set strict punishment measures for drug driving behavior.The administrative law's crackdown on "drug driving" is too small to achieve the goal of deterring drug users.It is not feasible to rely solely on the regulation of administrative law to deal with the increasingly serious "drug driving" behavior. < Criminal Law Amendment (8) > after "drinking driving" is included in the crime of dangerous driving,There is a growing clamour for Drug-driving, which is comparable to the danger of drunk driving, to be criminalized.The behavior of "drug driving" is a problem that all countries in the world have to face. Many countries have begun the study of "drug driving" very early, and investigated the practices of other countries in the world. Most countries have brought "drug driving" into the scope of the criminal law.And set up severe punishment measures.It is necessary for us to follow the practice of other countries and bring the "drug driving" behavior which seriously threatens the safety of citizens' personal and property into the criminal law to ensure the safety of citizens' personal and property.
