【摘要】：本論文在詳細(xì)考察贛州市生態(tài)環(huán)境現(xiàn)實(shí)狀況的基礎(chǔ)上,通過綜合分析贛州市生態(tài)環(huán)境立法面臨的形勢與問題,認(rèn)真比較研究國內(nèi)外現(xiàn)有研究成果,結(jié)合贛州地方立法工作實(shí)際情況和立法學(xué)基本理論,對《立法法》修改和地方立法權(quán)進(jìn)行了分析,從中央與地方事權(quán)劃分的角度詳細(xì)闡述了贛州的生態(tài)環(huán)境地方立法權(quán)限。從適應(yīng)贛州生態(tài)環(huán)境狀況、完善生態(tài)環(huán)境保護(hù)法規(guī)體系、推進(jìn)贛南蘇區(qū)振興發(fā)展和生態(tài)文明先行示范區(qū)建設(shè)法治保障等方面,對贛州開展生態(tài)環(huán)境地方立法的必要性進(jìn)行了探討。圍繞贛州市生態(tài)環(huán)境保護(hù)立法規(guī)劃的編制與實(shí)施,提出了滿足生態(tài)文明建設(shè)需求、統(tǒng)籌考慮融合現(xiàn)有規(guī)范、構(gòu)建生態(tài)環(huán)境法規(guī)體系等制定立法規(guī)劃的基本要求,并科學(xué)設(shè)計(jì)了贛州市短期、中期、長期立法規(guī)劃的主要內(nèi)容,對下一步贛州市開展生態(tài)環(huán)境立法工作提出了具有參考價(jià)值的意見。綜合贛州市的自然生態(tài)條件、環(huán)境資源狀況、重點(diǎn)污染領(lǐng)域、社會發(fā)展訴求等因素,提出贛州市生態(tài)環(huán)境立法應(yīng)重點(diǎn)關(guān)注水資源保護(hù)與水污染防治、土壤環(huán)境保護(hù)和土壤污染防治、礦產(chǎn)資源保護(hù)與礦上生態(tài)環(huán)境恢復(fù)治理、森林資源與生態(tài)保護(hù)等領(lǐng)域,建立一批符合贛州特點(diǎn)、具有贛州特色的地方性法規(guī)。同時(shí),結(jié)合中央、省制定出臺的生態(tài)環(huán)境保護(hù)管理的決策部署,制定完善生態(tài)文明考評、自然資源資產(chǎn)產(chǎn)權(quán)管理、生態(tài)補(bǔ)償、污染物排放許可、環(huán)境監(jiān)管和案件審理等制度。最后,針對贛州市生態(tài)環(huán)境保護(hù)立法工作提出了幾點(diǎn)具體建議,提出在地方生態(tài)環(huán)境保護(hù)立法中要注重實(shí)用性、廣泛性和專業(yè)性;要抓緊修訂《贛州市環(huán)境保護(hù)管理辦法》,制定《贛州市生態(tài)環(huán)境保護(hù)條例》,切實(shí)提升贛州市生態(tài)環(huán)境保護(hù)工作法治化水平。
[Abstract]:Based on the detailed investigation of the actual situation of the ecological environment in Ganzhou City, this paper makes a comprehensive analysis of the situation and problems facing the legislation of the ecological environment of Ganzhou City, and makes a careful comparison of the existing research results at home and abroad.Based on the actual situation of local legislative work and the basic theory of legislation in Ganzhou, this paper analyzes the revision of the Legislative Law and the local legislative power, and expounds in detail the local legislative authority of Ganzhou from the angle of the division of the central and local administrative powers.In terms of adapting to the ecological environment situation in Ganzhou, perfecting the legal system of ecological environment protection, promoting the rejuvenation and development of the Soviet region in southern Jiangxi, and establishing the legal guarantee of the ecological civilization demonstration area,The necessity of local legislation on ecological environment in Ganzhou is discussed.Based on the compilation and implementation of the legislative planning for ecological environment protection in Ganzhou City, the basic requirements of making legislative planning are put forward to meet the needs of ecological civilization construction, to consider the integration of existing norms, and to construct the system of ecological environmental laws and regulations, etc.The main contents of the short, medium and long term legislative planning of Ganzhou are scientifically designed, and some valuable suggestions are put forward for the further development of the ecological environment legislation in Ganzhou.Based on the analysis of the natural ecological conditions, environmental resources, key pollution fields, social development demands and other factors in Ganzhou City, this paper puts forward that the ecological environment legislation of Ganzhou City should focus on the protection of water resources and the prevention and control of water pollution.In the fields of soil environmental protection and soil pollution prevention, mineral resources protection and mine ecological environment restoration, forest resources and ecological protection, a number of local laws and regulations which accord with the characteristics of Ganzhou and have the characteristics of Ganzhou have been established.At the same time, in combination with the central and provincial decision-making arrangements for ecological environmental protection management, the establishment and improvement of ecological civilization evaluation, property rights management of natural resources assets, ecological compensation, pollutant emission permits, environmental supervision and trial of cases and other systems.Finally, the author puts forward some concrete suggestions on the legislation of ecological environment protection in Ganzhou city, and puts forward that in the legislation of local ecological environment protection, attention should be paid to practicability, universality and professionalism.We should pay close attention to revising the measures for the Administration of Environmental Protection in Ganzhou City, formulate the regulations on Ecological Environmental Protection of Ganzhou City, and conscientiously raise the level of legalization of ecological environmental protection work in Ganzhou City.
