【摘要】：我國(guó)社區(qū)矯正制度從2002年開(kāi)始試點(diǎn),發(fā)展到如今已經(jīng)走過(guò)15個(gè)年頭,社區(qū)矯正要辦的好,不能僅靠政府大包大攬,還需要更多社會(huì)力量的參與。社會(huì)工作在我國(guó)的發(fā)展勢(shì)頭迅猛,已成為社會(huì)治理中的一支不可或缺的力量。當(dāng)前迫切需要社工機(jī)構(gòu)和大量社會(huì)工作者投入到社區(qū)矯正工作當(dāng)中去,因?yàn)樯鐓^(qū)矯正需要社會(huì)工作的價(jià)值理念和專業(yè)的工作方法,社會(huì)工作的價(jià)值理念和社區(qū)矯正的目標(biāo)是契合的,社會(huì)工作的專業(yè)工作方法運(yùn)用到社區(qū)矯正中具有其他學(xué)科所沒(méi)有的突出優(yōu)勢(shì)。這是由社會(huì)工作的專業(yè)特性所決定的。社會(huì)工作介入社區(qū)矯正雖已有一些實(shí)踐,取得了一些進(jìn)展,但也出現(xiàn)了一些問(wèn)題。本文圍繞社會(huì)工作介入社區(qū)矯正領(lǐng)域的現(xiàn)狀以及存在的問(wèn)題及發(fā)展對(duì)策展開(kāi)研究。全文分為四個(gè)部分,第一部分,闡述社會(huì)工作介入社區(qū)矯正問(wèn)題研究的研究背景與意義。研究背景包括我國(guó)社區(qū)矯正制度的發(fā)展歷程、社會(huì)工作介入社區(qū)矯正的實(shí)踐及存在的問(wèn)題值得關(guān)注。研究意義包括三個(gè)方面,有利于社區(qū)矯正制度的完善,切實(shí)的幫助到被矯正人員,使其真正回歸到正常的社會(huì)生活中。也有利于社區(qū)的和諧穩(wěn)定。同時(shí),對(duì)學(xué)界研究的與社有關(guān)社會(huì)工作與社區(qū)矯正的研究文獻(xiàn)進(jìn)行總結(jié)歸納。第二部分,有關(guān)概念界定及理論基礎(chǔ)。首先,通過(guò)閱讀大量文獻(xiàn)對(duì)比較重要的有關(guān)概念進(jìn)行界定,如社區(qū)矯正、矯正社會(huì)工作、社區(qū)矯正社會(huì)工作等相關(guān)概念。其次,對(duì)相關(guān)理論基礎(chǔ)進(jìn)行論述,包括社區(qū)矯正法學(xué)方面的理論以及矯正社會(huì)學(xué)方面的理論。社區(qū)矯正法學(xué)理論基礎(chǔ)有教育刑論、刑法謙抑主義思想、刑法經(jīng)濟(jì)性原則等。第三部分,社會(huì)工作介入社區(qū)矯正的現(xiàn)狀和問(wèn)題。選取幾個(gè)典型地域,通過(guò)實(shí)地調(diào)查和對(duì)有關(guān)人員進(jìn)行訪談,獲得第一手資料。進(jìn)而研究論述我國(guó)落后地區(qū)和發(fā)達(dá)地區(qū)社會(huì)工作介入社區(qū)矯正的發(fā)展現(xiàn)狀,指出落后地區(qū)雖然暫無(wú)社會(huì)工作者直接參與到社區(qū)矯正工作當(dāng)中,但有部分志愿者通過(guò)學(xué)習(xí)掌握社會(huì)工作價(jià)值理念和工作方法,嘗試著將之運(yùn)用到社區(qū)矯正工作中。發(fā)達(dá)地區(qū)社會(huì)工作介入社區(qū)矯正有兩種方式,一種是政府聘用社工人才加入到社區(qū)矯正工作隊(duì)伍,一種是政府購(gòu)買專業(yè)社工機(jī)構(gòu)的服務(wù)。通過(guò)研究社會(huì)工作介入到社區(qū)矯正的現(xiàn)狀,進(jìn)而從財(cái)政保障、政策法規(guī)、人才引進(jìn)等宏觀層面以及具體的社工介入社區(qū)矯正實(shí)務(wù)的微觀層面來(lái)對(duì)社會(huì)工作介入社區(qū)矯正所出現(xiàn)的問(wèn)題進(jìn)行分類把握。第四部分,完善社會(huì)工作介入社區(qū)矯正的建議。通過(guò)前文診斷出的社會(huì)工作介入社區(qū)矯正的疑難雜癥,最終提出一些具有針對(duì)性的切實(shí)可行的建議。認(rèn)為下一步在完善相關(guān)法律法規(guī),設(shè)立垂直專項(xiàng)資金,保障社工人才隊(duì)伍等方面均大有可為。
[Abstract]:The community correction system of our country began to pilot from 2002, and has now gone through 15 years. The community correction should be done well, and the government should not do it in a big way. More social forces are needed. Social work is developing rapidly in our country. Social work institutions and a large number of social workers are urgently needed to put into the community correction work, because community correction needs the value concept of social work and professional working methods. The value concept of social work is in line with the goal of community correction. The application of professional methods of social work to community correction has outstanding advantages that other disciplines do not have. This is determined by the professional characteristics of social work. Although social work has been involved in community correction, it has made some progress. But there are also some problems. This paper focuses on the current situation of social work intervention in the field of community correction and the existing problems and development countermeasures. The paper is divided into four parts, the first part, This paper expounds the research background and significance of social work intervention in community correction. The research background includes the development of community correction system in China. The practice and problems of social work intervention in community correction are worthy of attention. The research significance includes three aspects, which are conducive to the improvement of the community correction system, and to the correction personnel. It is also beneficial to the harmony and stability of the community. At the same time, the literature on social work and community correction in academic circles is summarized and summarized. The second part, First of all, through reading a lot of literature to define the more important concepts, such as community correction, correction of social work, community correction of social work and other related concepts. The related theoretical basis is discussed, including the theory of community correction law and the theory of correction sociology. The theoretical basis of community correction law includes the theory of educational punishment, the thought of modesty of criminal law, the economic principle of criminal law and so on. The third part, The current situation and problems of social work intervention in community correction. Selected several typical areas, through field investigation and interviews with relevant personnel, Obtaining firsthand data, and then studying and discussing the current situation of social work intervention in community correction in backward and developed areas of our country, pointing out that although no social workers are directly involved in community correction work in backward areas for the time being, However, some volunteers try to apply it to community correction by learning to grasp the value concept and working methods of social work. There are two ways for social work to intervene in community correction in developed areas. One is that the government employs social workers to join the work force of community correction, the other is that the government buys the services of professional social work institutions. By studying the current situation of social work, social work is involved in community correction, and then from the perspective of financial security, policies and regulations, At the macro level such as the introduction of talents and the microcosmic level of social worker intervention in community correction practice, the problems arising from social work intervention in community correction are classified and grasped. Part four, The suggestion of perfecting social work intervention in community correction. Through the diagnosis of social work intervention in community correction, finally put forward some practical and pertinent suggestions. We think that the next step is to perfect the relevant laws and regulations. The establishment of vertical special funds, social workers and other aspects of the protection of talent are promising.
