【摘要】：隨著依法治國(guó)基本方略的不斷推行,社會(huì)對(duì)依法行政的要求也不斷提高,要全面實(shí)現(xiàn)依法行政,必須充分依靠行政法制監(jiān)督機(jī)制對(duì)行政權(quán)力進(jìn)行有效的監(jiān)督和制約。近年來(lái),全面依法治國(guó)深入推進(jìn),對(duì)規(guī)范市場(chǎng)監(jiān)管行政執(zhí)法行為提出更高要求,亟需健全完善市場(chǎng)執(zhí)法監(jiān)督機(jī)制。2014年底,石獅市探索開展市場(chǎng)監(jiān)管機(jī)構(gòu)大部制改革,整合工商、食藥、質(zhì)監(jiān)等部門職責(zé),成立石獅市市場(chǎng)監(jiān)督管理局,初步建立了新機(jī)構(gòu)的執(zhí)法監(jiān)督體系和機(jī)制,但在運(yùn)作中還存在不少問(wèn)題亟待盡快解決。本文充分應(yīng)用文獻(xiàn)分析法、案例分析法、比較分析法等研究方法,運(yùn)用分權(quán)與制衡理論,在對(duì)市場(chǎng)監(jiān)管執(zhí)法及市場(chǎng)監(jiān)管執(zhí)法監(jiān)督的一般理論的研究成果進(jìn)行梳理的基礎(chǔ)上,結(jié)合筆者自己在石獅市市場(chǎng)監(jiān)管執(zhí)法監(jiān)督崗位的工作實(shí)踐和掌握第一手資料,全面分析石獅市市場(chǎng)監(jiān)管執(zhí)法監(jiān)督現(xiàn)狀。在分析現(xiàn)狀的基礎(chǔ)上梳理剖析石獅市市場(chǎng)監(jiān)管執(zhí)法監(jiān)督中存在的監(jiān)督領(lǐng)域覆蓋不全、內(nèi)部監(jiān)督流于形式,外部監(jiān)督存在缺位、執(zhí)法對(duì)象的監(jiān)督缺失、責(zé)任追究機(jī)制難以落實(shí)到位等問(wèn)題,并分析了存在上述問(wèn)題的原因,如內(nèi)部監(jiān)督機(jī)制有待健全、各大監(jiān)督主體的監(jiān)督能力有待提升、保障監(jiān)督的法律法規(guī)不完善等。在分析原因的基礎(chǔ)上,提出了實(shí)現(xiàn)市場(chǎng)監(jiān)管執(zhí)法監(jiān)督領(lǐng)域的全覆蓋、重視監(jiān)管對(duì)象的監(jiān)督、強(qiáng)化權(quán)力機(jī)關(guān)監(jiān)督制約效果、加強(qiáng)輿論監(jiān)督效能、完善司法監(jiān)督、提高市場(chǎng)監(jiān)管部門內(nèi)部監(jiān)督的有效性,完善法律法規(guī)建設(shè)等對(duì)策建議。本文嘗試從一線執(zhí)法者的角度提出建議和對(duì)策,為完善石獅市市場(chǎng)監(jiān)管執(zhí)法監(jiān)督機(jī)制做拋磚引玉的前期思考。
[Abstract]:With the continuous implementation of the basic strategy of governing the country according to law, the requirements of the society for administration by law are constantly raised. In order to fully realize the administration by law, we must fully rely on the supervision mechanism of the administrative legal system to effectively supervise and restrict the administrative power. To comprehensively administer the country in accordance with the law, put forward higher requirements for standardizing the conduct of market supervision and administrative law enforcement. By the end of 2014, there is an urgent need to improve and improve the market law enforcement supervision mechanism. Shishi City is exploring the development of a large department system reform of market regulatory bodies, and the integration of industry and commerce, food and medicine. The responsibility of quality supervision and other departments, the establishment of Shishi City Market Supervision Administration, the preliminary establishment of a new agency of law enforcement supervision system and mechanism, but in operation there are still many problems need to be resolved as soon as possible. Comparative analysis and other research methods, using the theory of separation of powers and checks and balances, on the basis of combing the research results of the general theory of market supervision and law enforcement supervision, Combined with the author's own work practice and first-hand information in Shishi market supervision and law enforcement supervision post, On the basis of the analysis of the present situation, the existing supervision fields in Shishi market supervision and law enforcement supervision are not complete, the internal supervision is a mere formality, and the external supervision is absent. The lack of supervision of the law enforcement object, the difficulty of implementing the accountability mechanism, and so on. The reasons for the above problems are analyzed. For example, the internal supervision mechanism needs to be improved, and the supervisory ability of the major supervisory bodies needs to be improved. Based on the analysis of the reasons, the author puts forward that the market supervision and law enforcement supervision should cover the whole field, attach importance to the supervision of the object of supervision, strengthen the effect of supervision and restriction by the power organs, and strengthen the effectiveness of public opinion supervision. Improve judicial supervision, improve the effectiveness of internal supervision of market regulators, perfect the construction of laws and regulations and other countermeasures. This paper tries to put forward suggestions and countermeasures from the perspective of front-line law enforcers. In order to improve the Shishi market supervision and law enforcement mechanism to do the preliminary thinking.
