網絡約租車消費者權益保護法律問題研究

【摘要】:隨著互聯網經濟的發(fā)展,"互聯網+"模式已經成為了新寵,在共享經濟的大背景下,出租車行業(yè)率先邁開了步伐,網絡預約出租車的時代正式開啟。網約車將閑置的資源、勞動力進行優(yōu)化配置,提高了各種資源要素的利用率,使人們享受到相對優(yōu)惠的價格,更加人性化的服務,更自由的選擇和更快捷的支付,網約車正在改變我們的出行方式,影響我們的消費模式。網約車快速發(fā)展的同時,也存在著侵害消費者權益的隱患。首先,網約車經營主體的法律地位并不明確,導致出現對消費者侵權的情形時可能產生互相推諉的情況;其次,網約車消費者在知情權、隱私權、安全保障權、求償權及自由選擇權存在受侵害的風險。再次,政府部門的監(jiān)督和管理僵化使得消費者在遭遇侵權以后獲償困難。文章首先明確了網約車各個主體的法律地位,以便在出現損害網約車消費者權益的情形時,認定承擔賠償責任的主體。其次,分析現有的網約車市場存在的問題,主要從消費者的角度進行分析,將其中損害消費者的情況予以分類,并探究了產生這些問題的原因。再次,借鑒國外網約車對消費者權益保護方面的經驗,補充我國關于網絡約租車消費者權益保護市場規(guī)制的研究,提出對網絡約車消費者權益保護的法律規(guī)制的制度完善途徑,建議加強合作監(jiān)管、建立完善市場準入制度、建立完善信用等級體系、建立第三方投訴中心、建立定金制度、保險救濟制度,從而使得網約車服務在社會主義市場經濟中健康有序地發(fā)展。
[Abstract]:With the development of the Internet economy, the "Internet" model has become a new favorite. Under the background of the sharing economy, the taxi industry has taken the lead and the era of online taxi booking has been officially opened. By optimizing the allocation of labor force, increasing the utilization rate of various resource elements, making people enjoy relatively favorable prices, more humanized services, freer choices and faster payment, the net car ride is changing the way we travel. Affect our consumption pattern. With the rapid development of the net car, there is also the hidden trouble of infringing on the rights and interests of the consumer. First, the legal status of the main body of the net car rental business is not clear. As a result of the occurrence of infringement on consumers, there may be a situation of prevarication between consumers. Secondly, the right to know, the right to privacy, the right to security, the right to claim and the right to choose freely are at risk of being infringed. Again, The inflexible supervision and management of government departments make it difficult for consumers to obtain compensation after they encounter infringement. Firstly, the article clarifies the legal status of each subject in order to damage the rights and interests of consumers. Second, analyzing the problems existing in the existing market of ride-hailing, mainly from the perspective of consumers, and classifying the cases in which the consumers are harmed. And explore the reasons for these problems. Thirdly, draw lessons from the experience of foreign countries to protect the rights and interests of consumers, and supplement the research on the market regulation of the protection of the rights and interests of the network charter car consumers in our country. This paper puts forward the ways to perfect the system of the legal regulation on the protection of the rights and interests of the consumers in the network, and suggests to strengthen the cooperative supervision, to establish and perfect the system of market access, to establish and perfect the credit rating system, to establish the third party complaint center, and to establish the deposit system. Insurance relief system, so that the network ride-hailing service in the socialist market economy in a healthy and orderly development.
