行政規(guī)范性文件的識(shí)別

【摘要】:隨著我國(guó)對(duì)行政規(guī)范性文件監(jiān)管的日趨完善,從源頭上保證了依法行政。但是,目前我國(guó)在法制統(tǒng)一上存有一個(gè)嚴(yán)重的問(wèn)題——諸多行政公文制定主體為逃避監(jiān)管而使得滿足行政規(guī)范性文件構(gòu)成要素的文件仍以普通行政公文形式公布。這不僅影響我國(guó)法治國(guó)家的建設(shè)、法治社會(huì)的實(shí)現(xiàn)以及法治政府的形成,而且不利于公民、法人或其他組織維護(hù)其合法權(quán)益。規(guī)制此類情況需要增加新的行政公文管理制度,在所有行政公文出臺(tái)之前進(jìn)行前置識(shí)別程序。行政公文的前置識(shí)別程序在行政規(guī)范性文件管理中稱為行政規(guī)范性文件的識(shí)別。目前,我國(guó)學(xué)界與現(xiàn)行有效的立法性文件中并未對(duì)行政規(guī)范性文件的性質(zhì)進(jìn)行深入研究與詳細(xì)規(guī)定,無(wú)統(tǒng)一的識(shí)別標(biāo)準(zhǔn)、未單獨(dú)設(shè)置行政規(guī)范性文件識(shí)別程序,以及行政規(guī)范性文件的管理人員配置不合理等是行政規(guī)范性文件識(shí)別難以進(jìn)行的最大障礙,解決這類問(wèn)題迫在眉睫。行政規(guī)范性文件識(shí)別能否開(kāi)展的首要因素在于識(shí)別標(biāo)準(zhǔn),其由共同要素與差別要素共同構(gòu)成,共同要素包含普遍約束力與反復(fù)適用性;差別要素則一般包括制定主體、程序合法、涉及公民權(quán)利義務(wù)中的一項(xiàng)或者多項(xiàng)要素。通過(guò)對(duì)現(xiàn)有識(shí)別標(biāo)準(zhǔn)分析與評(píng)價(jià),取長(zhǎng)補(bǔ)短,建立新的識(shí)別標(biāo)準(zhǔn)的基本框架,以增加我國(guó)規(guī)范性文件理論研究范圍、促進(jìn)行政規(guī)范性文件管理制度的完善。重構(gòu)識(shí)別標(biāo)準(zhǔn)更是為了滿足對(duì)行政規(guī)范性文件進(jìn)行監(jiān)管的需要、司法機(jī)關(guān)對(duì)行政規(guī)范性文件進(jìn)行附帶審查的需要、公民尋求救濟(jì)的需要;達(dá)到規(guī)制我國(guó)行政公文不規(guī)范的情形,盡量減少甚至避免行政機(jī)關(guān)或者其他公權(quán)力機(jī)關(guān)制定具有行政規(guī)范性文件的實(shí)質(zhì)的行政公文,卻以非行政規(guī)范性文件的形式發(fā)布的情況的目的;為我國(guó)法制的統(tǒng)一,法治國(guó)家的建成、法治社會(huì)的建成、法治政府的實(shí)現(xiàn)提供條件。
[Abstract]:With the improvement of the supervision of administrative normative documents in our country, the administration according to law is guaranteed from the source. However, At present, there is a serious problem in the unification of the legal system in our country-many administrative document makers make the documents that satisfy the constituent elements of administrative normative documents to be published in the form of ordinary administrative documents in order to evade supervision. Affecting the construction of our country under the rule of law, The realization of a society ruled by law and the formation of a government ruled by law are not conducive to the protection of the legitimate rights and interests of citizens, legal persons or other organizations. The pre-identification procedure of administrative documents is called the identification of administrative normative documents in the management of administrative normative documents. The nature of administrative normative documents has not been thoroughly studied and detailed in Chinese academic circles and current effective legislative documents, there is no uniform identification standard, and the identification procedure of administrative normative documents has not been set up separately. And the unreasonable allocation of administrative normative documents is the biggest obstacle to the identification of administrative normative documents. It is urgent to solve this kind of problems. The most important factor for the identification of administrative normative documents is the identification standard. It consists of common elements and different elements, common elements include universal binding force and repeated applicability, and differential elements generally include the establishment of the subject, the procedure is legal, It involves one or more elements of the civil rights and obligations. By analyzing and evaluating the existing identification standards, we can learn from each other and establish the basic framework of the new identification standards, so as to increase the scope of theoretical research on the normative documents in our country. To promote the improvement of the administrative normative document management system. Reconstruction of the identification standard is to meet the need of the supervision of the administrative normative documents, the judicial organs to the administrative regulatory documents of the need for incidental review, citizens need to seek relief; To regulate the irregularities of administrative documents in our country, and to minimize or even avoid administrative documents with the substance of administrative normative documents formulated by administrative organs or other organs of public power, But the purpose of issuing in the form of non-administrative normative documents is to provide the conditions for the unification of the legal system, the establishment of a country ruled by law, the establishment of a society governed by law, and the realization of a government ruled by law.
