【摘要】：同性戀作為一種逐漸出現(xiàn)在公眾面前的社會(huì)現(xiàn)象,在經(jīng)歷了非病理化到目前越來(lái)越多的同性戀者勇于"出柜",除了民眾對(duì)同性戀群體的看法變得客觀的原因外,更重要的原因還在于人權(quán)意識(shí)覺(jué)醒的影響,以及對(duì)傳統(tǒng)文化的態(tài)度有所改變。同性戀者希望能與異性戀者一樣,擁有締結(jié)婚姻的權(quán)利,享有自由表達(dá)情感的權(quán)利等,必須獲得社會(huì)、文化、法律的認(rèn)同,這首先就是要明確同性戀問(wèn)題在憲法上的屬性。只有當(dāng)憲法保障同性戀者的基本權(quán)利,法律對(duì)其各方面的權(quán)益予以明確保護(hù)后,同性戀者各項(xiàng)權(quán)益才能依法得到主張與行使。對(duì)同性戀權(quán)益保護(hù)的明確及細(xì)化,不僅需要從宏觀上消除對(duì)同性戀的社會(huì)歧視,做到能真正認(rèn)同,從中觀上對(duì)同性戀者的權(quán)利和社會(huì)保障方面的利益予以立法保障,從微觀上還要處理好同性戀人群與其家庭成員的關(guān)系,樹(shù)立對(duì)安全性交行為的概念,提供一個(gè)對(duì)同性戀者的生存與發(fā)展的各方面都寬容的社會(huì)環(huán)境、全面完善的法律與制度環(huán)境。2016年孫文麟、胡明亮因不服婚姻登記行政行為,起訴長(zhǎng)沙市芙蓉區(qū)民政局,長(zhǎng)沙市芙蓉區(qū)人民法院依據(jù)《中華人民共和國(guó)婚姻法》及《婚姻登記條例》駁回了孫文麟、胡明亮的訴訟請(qǐng)求,該案件被稱(chēng)為"中國(guó)同性婚姻第一案"。雖然目前我國(guó)法律上明確不認(rèn)可同性婚姻,但該案的出現(xiàn)引起了社會(huì)各界的激烈討論。本文從憲法理論角度出發(fā),以"中國(guó)同性婚姻第一案"為切入點(diǎn),在立足于我國(guó)現(xiàn)實(shí)情況的基礎(chǔ)之上,同時(shí)對(duì)域外國(guó)家同性戀權(quán)益保護(hù)的制度進(jìn)行了借鑒和考察,以探索適合我國(guó)現(xiàn)實(shí)情況的同性戀權(quán)益保護(hù)之出路。
[Abstract]:Homosexuality, as a social phenomenon appearing in public gradually, has experienced non-pathological changes until now more and more homosexuals have the courage to "come out". Besides the reasons why the public's view of the gay community has become objective, Even more important is the impact of the awareness of human rights awareness and the change in attitudes towards traditional culture. Homosexuals want to have the same right as heterosexuals to enter into marriage and enjoy the right to express their feelings freely, etc. It must be recognized by society, culture and law. First of all, it is necessary to clarify the constitutional attributes of homosexuality. Only when the Constitution guarantees the fundamental rights of homosexuals and the rights and interests of homosexuals are clearly protected by the law, In order to obtain the claim and exercise of the rights and interests of homosexuals according to law, the explicit and detailed protection of the rights and interests of homosexuals not only needs to eliminate social discrimination against homosexuals from a macro perspective, but also to truly identify with them. We should legislate to protect the rights of homosexuals and the interests of social security from the middle point of view, deal with the relationship between the gay people and their family members from the micro level, and establish the concept of safe sex. To provide a tolerant social environment and a comprehensive legal and institutional environment for the survival and development of homosexuals. In 2016, Sun Wenlin, Hu Mingliang sued the Furong District Civil Affairs Bureau of Changsha City for refusing to accept the administrative act of marriage registration. According to the Marriage Law of the people's Republic of China and the Marriage Registration regulations, the people's Court of Furong District of Changsha rejected Sun Wenlin, Hu Mingming's lawsuit request. This case is called "the first case of Chinese same-sex marriage". Although the law of our country does not recognize same-sex marriage explicitly at present, the emergence of this case has aroused heated discussion from all walks of life. Taking the first case of same-sex marriage in China as the starting point, based on the reality of our country, this paper also makes a reference and investigation on the system of protecting the rights and interests of homosexuality in foreign countries. In order to explore the reality of our country to protect gay rights and interests of the way out.
