【摘要】：2015年11月30日,法國巴黎召開了《聯(lián)合國氣候變化框架公約》第21次締約方會議,經(jīng)過12天的討論,《巴黎協(xié)議》最終獲得通過。該協(xié)議凝結(jié)了國際社會在應(yīng)對全球氣候變化問題上最廣泛的共識,彰顯了國家利益和國際利益的均衡,是全球改善氣候變化問題進(jìn)程的里程碑事件。文件共29條,包括應(yīng)對全球氣候問題多層面和多角度的內(nèi)容,尤其是共同但有區(qū)別責(zé)任原則的應(yīng)用進(jìn)一步得到了發(fā)展。該原則是國際環(huán)境法領(lǐng)域的基本原則,堅持共同但別責(zé)任原則是加強(qiáng)全球氣候變化進(jìn)程中國際合作的堅實基礎(chǔ)。共同但有區(qū)別責(zé)任原則的發(fā)展過程就是該原則的應(yīng)用過程,該原則產(chǎn)生的理論基礎(chǔ)和實踐基礎(chǔ),決定了該原則必須順應(yīng)時代的發(fā)展,因此持續(xù)關(guān)注該原則的發(fā)展變化是十分必要的。本文以應(yīng)對全球氣候變化為背景,主要針對《巴黎協(xié)議》中共同但有區(qū)別責(zé)任原則的發(fā)展內(nèi)容進(jìn)行研究,分析共同但有區(qū)別責(zé)任原則的發(fā)展特點,對該原則在發(fā)展過程中我國面臨的挑戰(zhàn)進(jìn)行總結(jié),并提出相應(yīng)對策。本文總共分為五個部分,按照引言、概述、理論基礎(chǔ)、新發(fā)展以及挑戰(zhàn)與應(yīng)對的順序進(jìn)行闡釋,具體內(nèi)容設(shè)置如下:第一章引言部分,首先,從文章的選題著手,介紹共同但有區(qū)別責(zé)任原則得以發(fā)展的國際背景,探究該原則發(fā)展的現(xiàn)實意義,從論文研究的目的出發(fā)闡明研究價值;其次,介紹國內(nèi)和國外有關(guān)共同但有區(qū)別責(zé)任原則的研究成果,為選題的研究提供方向,為論文的撰寫提供素材;最后,總結(jié)研究方法,歸納創(chuàng)新內(nèi)容。第二章概述部分,分別從共同但有區(qū)別責(zé)任原則的內(nèi)涵、歷史背景和歷史進(jìn)程對該原則進(jìn)行闡釋,關(guān)于該原則歷史進(jìn)程的部分,結(jié)合相關(guān)的國際條約將該原則的歷史發(fā)展進(jìn)程劃分為萌芽、確立、應(yīng)用和發(fā)展四個階段,理順該原則的發(fā)展過程。第三章理論基礎(chǔ)部分,首先,共同但有區(qū)別責(zé)任原則產(chǎn)生的法學(xué)理論,從可持續(xù)發(fā)展理論、公共信托理論和污染者付費(fèi)三個方面進(jìn)行介紹;其次,對該原則產(chǎn)生的倫理學(xué)理論進(jìn)行介紹,主要介紹非人類中心主義和環(huán)境正義理論對該原則產(chǎn)生的影響;最后,以外部經(jīng)濟(jì)理論為研究中心,闡釋該原則產(chǎn)生的經(jīng)濟(jì)學(xué)理論。第四章是介紹共同但有區(qū)別責(zé)任原則在《巴黎協(xié)議》中的新發(fā)展。首先,探究該原則在內(nèi)涵上的豐富與發(fā)展;其次,以該原則的具體應(yīng)用為著手點,探究該原則的發(fā)展內(nèi)容,從國家自主貢獻(xiàn)模式、資金援助機(jī)制的操作性和行動和支助透明度的監(jiān)督機(jī)制為中心進(jìn)行探究;再次,梳理共同但有區(qū)別責(zé)任原則的國際合作基礎(chǔ),從合作依據(jù)、合作主體、合作利益和合作模式四個方面,探尋新的國際背景下的國際合作關(guān)系;最后,對共同但有區(qū)別責(zé)任原則的發(fā)展特點進(jìn)行歸納,總結(jié)《巴黎協(xié)議》賦予該原則的新意義。第五章是我國在共同但有區(qū)別責(zé)任原則的發(fā)展過程中面臨的挑戰(zhàn)與應(yīng)對。首先,強(qiáng)調(diào)我國在該原則發(fā)展過程中起到的作用;其次,從我國展開國際合作、推動國內(nèi)經(jīng)濟(jì)發(fā)展進(jìn)程、資金機(jī)制和技術(shù)開發(fā)移轉(zhuǎn)機(jī)制四個方面分析我國所面對的挑戰(zhàn);最后,就上述挑戰(zhàn)提出相應(yīng)的解決辦法。在當(dāng)前形勢下,探討如何促進(jìn)共同但有區(qū)別責(zé)任原則的積極發(fā)展,對于全球氣候變化的遏制和改善將有著十分重要的意義。
[Abstract]:In November 30, 2015, French Paris held a "United Nations Framework Convention on climate change on the twenty-first conference of the parties, after 12 days of discussion," Paris agreement ". The agreement is finally obtained by condensation of the international community the most widely in response to global climate change consensus on the issue, highlighting the national and international interests balance is the milepost the process of improving the events of the global climate change issues. A total of 29 documents, including the response to the global climate problem of multi-level and multi angle, especially the application of the principle of common but differentiated responsibilities has been further developed. The principle is the basic principle of International environmental law, adhere to the principle of common but not liability principle is a solid foundation for strengthening international cooperation in the process of global climate change.
