【摘要】:近年來(lái),隨著互聯(lián)網(wǎng)的發(fā)展和電子科技的進(jìn)步,網(wǎng)絡(luò)購(gòu)物已然成為一種新興的消費(fèi)方式。我國(guó)的網(wǎng)絡(luò)購(gòu)物市場(chǎng)發(fā)展極其迅速,交易規(guī)模翻番,越來(lái)越多的消費(fèi)者參與到網(wǎng)絡(luò)購(gòu)物中。消費(fèi)者通過(guò)網(wǎng)絡(luò)給自己的生活帶來(lái)更多便利,與此同時(shí),一些網(wǎng)絡(luò)購(gòu)物糾紛也不可避免的隨之出現(xiàn),如賣家提供虛假信息、支付貨款后賣家不發(fā)貨、退換商品困難等。面對(duì)頻繁發(fā)生的網(wǎng)絡(luò)購(gòu)物糾紛,如何規(guī)范網(wǎng)絡(luò)交易市場(chǎng),促進(jìn)網(wǎng)絡(luò)交易健康發(fā)展,維護(hù)網(wǎng)絡(luò)消費(fèi)者的正當(dāng)權(quán)益已經(jīng)成為亟待解決的問(wèn)題。 本文首先分析了網(wǎng)絡(luò)購(gòu)物中侵害消費(fèi)者權(quán)益的類型。逐類分析消費(fèi)者的安全權(quán)、隱私權(quán)、知情權(quán)、公平交易權(quán)、索賠權(quán)是怎樣被侵害的。接下來(lái)剖析網(wǎng)絡(luò)購(gòu)物消費(fèi)者權(quán)益受損的原因。究其實(shí)質(zhì),產(chǎn)生消費(fèi)者權(quán)益保護(hù)問(wèn)題的根由在于網(wǎng)絡(luò)消費(fèi)的特殊性,即網(wǎng)絡(luò)消費(fèi)中更易發(fā)生信息不對(duì)稱,進(jìn)而消費(fèi)者權(quán)益更容易受侵害。同時(shí)相關(guān)法律制度不完善、救濟(jì)機(jī)制缺失、消費(fèi)者與經(jīng)營(yíng)者經(jīng)濟(jì)和社會(huì)地位的不平等也是造成網(wǎng)絡(luò)購(gòu)物維權(quán)困難的主要原因。其次研究境外立法的經(jīng)驗(yàn)并從中發(fā)掘?qū)ξ覈?guó)的啟示。歐盟、美國(guó)、德國(guó)、日本等發(fā)達(dá)國(guó)家電子商務(wù)較之我國(guó)起步較早,在法律規(guī)定以及制度的建立上已走過(guò)不少的彎路,并且積累了許多經(jīng)驗(yàn)。其對(duì)信息披露明確性的規(guī)定、消費(fèi)者無(wú)條件撤銷權(quán)的確定、在線糾紛統(tǒng)一管轄的規(guī)定都有力的保護(hù)了消費(fèi)者的個(gè)人利益。國(guó)外的立法經(jīng)驗(yàn)可以借鑒使用,但不能盲目的進(jìn)行法律的移植,充分考慮我國(guó)國(guó)情。最后指出我國(guó)現(xiàn)行法律制度對(duì)網(wǎng)絡(luò)消費(fèi)者權(quán)益保護(hù)的不足,并提出完善建議。通過(guò)分析我國(guó)網(wǎng)絡(luò)消費(fèi)者權(quán)益保護(hù)的立法現(xiàn)狀,發(fā)現(xiàn)現(xiàn)行立法的不足,在法律制度、行政監(jiān)管、.行業(yè)自律、網(wǎng)絡(luò)信用系統(tǒng)的建立等方面提出完善建議。
[Abstract]:In recent years, with the development of the Internet and the progress of electronic technology, online shopping has become a new consumption mode. More and more consumers participate in online shopping. Consumers bring more convenience to their lives through the Internet. At the same time, some online shopping disputes inevitably appear, such as sellers provide false information. In the face of frequent online shopping disputes, how to standardize the online trading market and promote the healthy development of online transactions, Safeguarding the legitimate rights and interests of network consumers has become an urgent problem to be solved. This paper first analyzes the types of consumers' rights and interests in online shopping. It analyzes consumers' rights to security, privacy, information, fair trade, etc. How the right of claim is infringed. Next, analyze the reason why the rights and interests of consumers in online shopping are damaged. In essence, the root cause of the problem of consumer rights and interests protection lies in the particularity of network consumption, that is, information asymmetry is more likely to occur in network consumption. Moreover, consumers' rights and interests are more vulnerable to infringement. At the same time, the relevant legal system is not perfect, and the relief mechanism is missing. The inequality between consumers and operators' economic and social status is also the main reason for the difficulty of online shopping rights. Secondly, we study the experience of overseas legislation and explore the enlightenment to our country. The European Union, the United States, Germany, the European Union, the United States, Germany, the European Union, the United States, Germany, The electronic commerce of Japan and other developed countries started earlier than that of our country, and they have already gone through a lot of detours in the establishment of laws and regulations, and accumulated a lot of experience. The determination of consumers' unconditional right of rescission and the provisions of unified jurisdiction over online disputes have effectively protected the personal interests of consumers. Foreign legislative experience can be used for reference, but the transplantation of laws cannot be blindly carried out. Finally, it points out the deficiency of the current legal system of our country to the protection of network consumers' rights and interests, and puts forward some suggestions to perfect it. By analyzing the current legislative situation of the protection of network consumers' rights and interests in our country, we find out the shortcomings of the current legislation. In the legal system, administrative supervision, industry self-discipline, the establishment of network credit system, put forward some suggestions.
