【摘要】：貧困,一直是制約我國農(nóng)村經(jīng)濟(jì)發(fā)展的重大問題,為了更好地解決這個問題,農(nóng)村社會救助就是一項(xiàng)重要的制度安排。農(nóng)村社會救助制度,是指農(nóng)村居民在因年老、疾病等任何原因?qū)е律钬毨?難以維持最低的生活水平時,由政府提供最低標(biāo)準(zhǔn)的、可持續(xù)的金錢或服務(wù)的社會救助制度。它旨在保障農(nóng)村弱勢群體最基本的生活,促進(jìn)社會公平,維護(hù)和諧社會的穩(wěn)定。農(nóng)村社會救助由于其自身的公共產(chǎn)品屬性、無償性等特點(diǎn),完全交由市場支配容易導(dǎo)致社會資源的供給失靈,因此,強(qiáng)調(diào)政府救助責(zé)任即是正義使然,政府應(yīng)當(dāng)承擔(dān)農(nóng)村社會救助的主要責(zé)任。在“精準(zhǔn)扶貧”的大背景下,筆者認(rèn)為,為促進(jìn)我國農(nóng)村社會救助制度的進(jìn)一步發(fā)展,可以從“精準(zhǔn)救助”的角度出發(fā)對農(nóng)村社會救助政府責(zé)任的承擔(dān)進(jìn)行研究,以期能對政府的農(nóng)村社會救助責(zé)任精準(zhǔn)化履行發(fā)揮些許光熱。本文通過對相關(guān)文獻(xiàn)的研究,首先對相關(guān)概念、理論及我國現(xiàn)實(shí)基礎(chǔ)進(jìn)行了闡述,論證了政府作為農(nóng)村社會救助主要責(zé)任主體的合理性和必要性,接著反思了我國政府在目前的農(nóng)村社會救助工作中存在的失責(zé)的問題,分析了政府在出現(xiàn)社會救助糾紛時應(yīng)該承擔(dān)的法律責(zé)任,以及被救助主體的權(quán)利救濟(jì)途徑。通過闡述美、德、英三國政府進(jìn)行的農(nóng)村社會救助工作,以期對我國政府責(zé)任的履行有所啟示。最后,結(jié)合“精準(zhǔn)救助”的政策導(dǎo)向,筆者對我國農(nóng)村社會救助政府責(zé)任的精準(zhǔn)履行提出了若干完善建議。
[Abstract]:Poverty has always been a major problem restricting the development of rural economy in our country. In order to solve this problem better, rural social assistance is an important institutional arrangement. When disease or any other cause of poverty makes it difficult to maintain a minimum standard of living, the Government provides a minimum standard of social assistance for sustainable money or services... it is designed to guarantee the most basic livelihood of the rural vulnerable, Promoting social equity and maintaining the stability of a harmonious society. Due to its own characteristics of public goods and gratuitous nature, social assistance in rural areas can easily lead to the failure of the supply of social resources at the disposal of the market. It is emphasized that the responsibility of government assistance is just, and the government should bear the main responsibility of rural social assistance. In the context of "precision poverty alleviation", the author believes that in order to promote the further development of rural social assistance system in China, From the perspective of "precision relief", we can study the responsibility of the rural social assistance government, in order to play a little light on the precision implementation of the government's rural social assistance responsibility. First of all, the related concepts, theories and the actual basis of our country are expounded, and the rationality and necessity of the government as the main responsible subject of rural social assistance are demonstrated. Then it reflects on the problem of default existing in the present rural social assistance work, analyzes the legal responsibility that the government should bear when the social assistance disputes arise, and the right relief ways of the rescued subject. The rural social assistance work carried out by the governments of Germany and Britain in order to enlighten the implementation of our government's responsibilities. Finally, combined with the policy direction of "precision relief," The author puts forward some perfect suggestions on the precise implementation of the government's responsibility of rural social assistance in China.
