【摘要】:土地承包經(jīng)營是我國農(nóng)村實行家庭聯(lián)產(chǎn)承包責任制以后,農(nóng)地的主要利用方式。《物權法》頒布后將土地承包經(jīng)營權界定為用益物權,根據(jù)取得方式的不同,分為以家庭承包方式取得的土地承包經(jīng)營權和以其他方式取得的土地承包經(jīng)營權。抵押是使用范圍最廣的一種擔保方式,通過設立抵押,可以充分發(fā)揮抵押物經(jīng)濟價值。隨著城鎮(zhèn)化、農(nóng)業(yè)現(xiàn)代化的發(fā)展,農(nóng)民不管是從事農(nóng)業(yè)生產(chǎn)還是非農(nóng)經(jīng)營,對資金的需求越來越多,土地承包經(jīng)營權作為農(nóng)民手中一項重要的財產(chǎn)權利,利用其進行抵押融資備受社會關注。但目前,我國法律只規(guī)定以其他方式取得的“四荒地”承包經(jīng)營權可以成為抵押的標的,而占農(nóng)地面積大多數(shù)的家庭承包土地承包經(jīng)營權抵押一直受到限制,不能適用當前農(nóng)村經(jīng)濟和社會發(fā)展的要求。因此,本文僅對以家庭承包方式取得的土地承包經(jīng)營權抵押進行研究,通過完善農(nóng)村土地承包經(jīng)營權抵押制度,實現(xiàn)農(nóng)村土地承包經(jīng)營權抵押。本文一共分為四個部分:第一部分是對農(nóng)村土地承包經(jīng)營權抵押的內(nèi)涵的論述。主要分析了農(nóng)村土地承包經(jīng)營權抵押的概念、法律特征、意義和可行性。第二部分主要分析農(nóng)村土地承包經(jīng)營權抵押的立法現(xiàn)狀及存在的問題。對與農(nóng)村土地承包經(jīng)營權抵押有關的法律進行了分析,并且從抵押主體、抵押標的、抵押設立、抵押實現(xiàn)以及相關配套制度等方面,剖析阻礙農(nóng)村土地承包經(jīng)營權抵押的問題。第三部分總結(jié)農(nóng)村土地承包經(jīng)營權抵押的實踐經(jīng)驗。雖然法律對農(nóng)村土地承包經(jīng)營權抵押還沒有重大的突破,但根據(jù)國家有關政策,一些地方應經(jīng)開始農(nóng)地抵押的實踐,這些實踐為制度創(chuàng)新提供了支持。第四部分是農(nóng)村土地承包經(jīng)營權抵押制度的完善。通過在第二部分的問題分析,結(jié)合第三部分的實踐探索,提出對農(nóng)村土地承包經(jīng)營權抵押人解除不必要的限制、放開抵押標的范圍、抵押采取登記要件主義、抵押權實現(xiàn)方式的選擇以及相關配套制度的完善等建議。
[Abstract]:After the implementation of the household contract responsibility system in rural areas, land contractual management is the main way to use farmland. After the promulgation of the Law of Real Rights, the land contractual management right is defined as usufruct right, according to the different ways of obtaining. It is divided into the land contractual management right obtained by the family contract method and the land contract management right obtained by other means. The mortgage is the most widely used one kind of guarantee way, through establishing the mortgage. With the development of urbanization and agricultural modernization, farmers, whether engaged in agricultural production or non-agricultural operations, the demand for more and more funds. As an important property right in the hands of farmers, the right of land contractual management is paid more and more attention by the society. The law of our country only stipulates that the contracted management right of "four wasteland" obtained by other means can be the object of mortgage, and the mortgage of the right to contract and manage the land contracted by families, which accounts for the majority of farmland area, has been restricted all the time. Therefore, this paper only studies the mortgage of land contractual management right obtained by the way of family contract, through perfecting the mortgage system of land contract management right in rural areas. This paper is divided into four parts: the first part discusses the connotation of rural land contractual management right mortgage, mainly analyzes the concept of rural land contractual management right mortgage. The second part mainly analyzes the current situation and the existing problems of the rural land contractual management right mortgage, and analyzes the law related to the rural land contractual management right mortgage. And from the mortgage subject, mortgage subject, mortgage establishment, mortgage realization and related supporting system and so on. The third part summarizes the practical experience of rural land contractual management right mortgage. Although there is no significant breakthrough in the law of rural land contractual management right mortgage. However, according to the relevant national policies, some places should begin the practice of agricultural land mortgage. These practices provide support for institutional innovation. Part 4th is the improvement of the mortgage system of rural land contractual management right. Through the second part of the problem analysis, combined with the third part of the practice exploration. The paper puts forward some suggestions to the mortgagors of the contracted management right of rural land, such as lifting unnecessary restrictions, liberalizing the scope of the subject matter of the mortgage, adopting registration essentialism, choosing the way to realize the mortgage and perfecting the relevant supporting system.
