【摘要】:隨著經(jīng)濟(jì)全球化趨勢(shì)和全球勞動(dòng)力轉(zhuǎn)移,外國人在華工作的情況日益增多,就業(yè)范圍也更加寬廣,特別是在中國加入WTO之后,在我國就業(yè)的外國人已從1996年頒布《外國人在華就業(yè)管理規(guī)定》時(shí)的不足一萬人,增添到2006年的18萬人,據(jù)勞動(dòng)局有關(guān)就業(yè)管理部門的統(tǒng)計(jì),至2011年末持外國人在華就業(yè)證在我國就業(yè)的外國人已達(dá)到24.19萬人,從2006年發(fā)展至2011年,在華就業(yè)的外國人數(shù)增長了34.4%,截至2016年底在華非法就業(yè)者已高達(dá)30萬人。過多的外國就業(yè)者嚴(yán)重沖擊了我國勞動(dòng)市場(chǎng)的穩(wěn)定性,更為嚴(yán)重的非法就業(yè)問題已經(jīng)涉及到危害國家主權(quán)和安全,危害社會(huì)秩序和衛(wèi)生安全等方面。當(dāng)前我國立法存在立法落后、立法規(guī)制范圍不全面,缺少國民待遇例外在新領(lǐng)域的規(guī)制,對(duì)非法就業(yè)者處罰力度較輕等問題。相關(guān)執(zhí)法部門間缺乏配合,執(zhí)法效力低下,對(duì)外國人在華就業(yè)的管理起不到威懾作用。因此本文的研究對(duì)解決外國人在華就業(yè)存在的法律問題,完善外國人在華就業(yè)的法律規(guī)制,保障我國勞動(dòng)市場(chǎng)穩(wěn)定性具有理論和現(xiàn)實(shí)意義。文章運(yùn)用了文獻(xiàn)研究、概念分析、類比研究的方法,從外國人在華就業(yè)的現(xiàn)狀入手,結(jié)合相關(guān)國際法理論,寫出我國缺乏對(duì)外國就業(yè)者宏觀調(diào)控的問題,主要包括在立法中缺乏對(duì)外國就業(yè)者總?cè)藬?shù)及就業(yè)范圍的控制;未明確體現(xiàn)國民待遇例外的就業(yè)領(lǐng)域;未擴(kuò)大國民待遇例外在新領(lǐng)域的規(guī)制范圍;對(duì)非法就業(yè)的雇主雇傭雙方的處罰力度不夠;各執(zhí)法部門間缺乏溝通配合導(dǎo)致執(zhí)法效率低下。文章借鑒了域外國家有關(guān)外國人就業(yè)的立法實(shí)踐,以保護(hù)本國勞動(dòng)力優(yōu)先為原則,制定統(tǒng)一立法規(guī)制外國人在華就業(yè),在立法中增加國民待遇例外內(nèi)容,對(duì)國民待遇例外進(jìn)行立法上的全面匯總。通過增強(qiáng)雇主責(zé)任制,加大對(duì)非法就業(yè)雇主的處罰力度。對(duì)外國人在華就業(yè)的總?cè)藬?shù)、工作類別及時(shí)間期限嚴(yán)格控制。增強(qiáng)各執(zhí)法部門間的相互配合,提高共同執(zhí)法效率。旨在解決外國人在華就業(yè)法律問題的同時(shí),加強(qiáng)在外國人就業(yè)管理方面的國際合作,以適應(yīng)同國際接軌的新發(fā)展模式,不斷完善我國的社會(huì)主義法制體系。
[Abstract]:With the trend of economic globalization and the transfer of global labor force, the situation of foreigners working in China is increasing day by day, and the scope of employment is wider, especially after China's entry into WTO. The number of foreigners employed in China has increased from less than 10,000 in 1996 when the regulations on the Administration of foreigners Employment in China was promulgated, to 180,000 in 2006, according to statistics of the relevant employment administration departments of the Labor Bureau. By end of 2011, the number of foreigners holding employment permits in China had reached 241,900. From 2006 to 2011, the number of foreigners employed in China increased by 34.4%. As of end of 2016, the number of illegal workers in China has reached 300,000. The excessive number of foreign workers has seriously affected the stability of China's labor market. The more serious problem of illegal employment has been involved in endangering national sovereignty and security, endangering social order and health security, etc. At present, legislation in our country is backward and the scope of legislative regulation is not comprehensive. Lack of national treatment exception in the new field of regulation, punishment of illegal workers and other issues. The lack of cooperation between the relevant law enforcement agencies, the effectiveness of law enforcement is low. The management of foreigners' employment in China can not be deterred. Therefore, the study of this paper will solve the legal problems of foreigners' employment in China and perfect the legal regulation of foreigners' employment in China. It is of theoretical and practical significance to ensure the stability of China's labor market. This paper applies the methods of literature research, conceptual analysis and analogical study, starting with the current situation of foreigners' employment in China, and combining with relevant international law theories. The problems of our country's lack of macro-control over foreign workers include the lack of control on the total number of foreign employed persons and the scope of employment in the legislation; Areas of employment that do not explicitly reflect exceptions to national treatment; Not expanding the scope of national treatment exception in the new field; The punishment of employers and employers who are employed illegally is not strong enough; The lack of communication among the law enforcement agencies leads to inefficient enforcement. This article draws lessons from the foreign countries' legislative practice on the employment of foreigners and takes the protection of the domestic labor force as the principle of priority. Make uniform legislation to regulate the employment of foreigners in China, increase the content of national treatment exception in the legislation, make a comprehensive legislative summary of national treatment exception, and strengthen the employer responsibility system. We will increase the penalties imposed on illegal employers, strictly control the total number of foreigners employed in China, the types of jobs and the duration of their work, and strengthen the cooperation among law enforcement agencies. To improve the efficiency of common law enforcement. The aim is to solve the legal problems of foreigners' employment in China, and at the same time, to strengthen international cooperation in the management of foreigners' employment, so as to adapt to the new development model in line with international standards. We will continue to improve our socialist legal system.
