【摘要】：我國非營利法人數(shù)量在不斷增長,截止到2015年末,數(shù)量有66.2萬個,增長率為9.2%,在科教文衛(wèi)、社會救助、慈善事業(yè)、生態(tài)環(huán)保等方面發(fā)揮了獨特的作用。非營利法人已經(jīng)成為當代社會結(jié)構(gòu)中不可或缺的一部分。盡管非營利法人在不斷發(fā)展壯大,問題也不可避免,最突出的是資金短缺,阻礙了非營利法人的健康發(fā)展。非營利法人為解決這一問題,開始開展經(jīng)營活動。非營利法人開展經(jīng)營活動解決了資金短缺問題,增強了自身獨立性,但是也存在一些問題。立法上對非營利法人開展經(jīng)營活動界定不清、規(guī)定不足,法律與現(xiàn)實存在沖突。為了更好的對我國非營利法人開展經(jīng)營活動進行規(guī)制,促進非營利法人持續(xù)發(fā)展,本文借鑒其他國家的先進立法和經(jīng)驗,結(jié)合我國非營利法人的發(fā)展現(xiàn)狀,提出法律上的建議。立法上明確允許非營利法人開展經(jīng)營活動和設定相關規(guī)則,并從內(nèi)外兩方面進行規(guī)制。希望本文的研究能為我國非營利法人的發(fā)展提供些許參考意義。
[Abstract]:As of end of 2015, the number of non-profit legal persons in China is growing, with a growth rate of 9.2 million, in science, education, culture and health, social assistance, philanthropy. Ecological environmental protection has played a unique role. Non-profit legal person has become an indispensable part of the contemporary social structure. The most outstanding is the shortage of funds, which hinders the healthy development of the non-profit legal person. In order to solve this problem, the non-profit legal person began to carry out business activities, and the non-profit legal person carried out business activities to solve the problem of the shortage of funds. Strengthen their own independence, but there are also some problems. Legislation on the non-profit legal person to carry out business activities is not clearly defined, inadequate provisions. There is a conflict between law and reality. In order to better regulate and promote the sustainable development of non-profit legal persons in China, this paper draws lessons from the advanced legislation and experience of other countries. Combined with the current situation of the development of the non-profit legal person in our country, this paper puts forward some legal suggestions. The legislation explicitly allows the non-profit legal person to carry out business activities and set up the relevant rules. The author hopes that the research in this paper can provide some reference significance for the development of non-profit legal person in China.
