【摘要】:學(xué)界對(duì)于勞動(dòng)合同法定變更的問(wèn)題尚缺乏系統(tǒng)研究,認(rèn)為勞動(dòng)法中存在法定變更的學(xué)者也不多見(jiàn)。這促使筆者從學(xué)理和法律規(guī)定兩個(gè)角度對(duì)勞動(dòng)合同法定變更制度進(jìn)行研究和解讀。本文就以保護(hù)勞動(dòng)者合法權(quán)益為立足點(diǎn),從民法和勞動(dòng)法的基本法理出發(fā),分析如何理解和把握勞動(dòng)合同法定變更制度,其中的關(guān)鍵在于兩項(xiàng)創(chuàng)新之處。一是理論上的創(chuàng)新,本文首先明確提出,基于實(shí)質(zhì)正義的要求,勞動(dòng)合同法定變更的概念于理應(yīng)當(dāng)存在,并運(yùn)用邏輯學(xué)中的定義規(guī)則對(duì)這一概念作出了定義,探討了其具有法定性、合意性、法律后果的多重性與立法目的的社會(huì)性等特點(diǎn),認(rèn)為其應(yīng)當(dāng)被定性為用人單位的義務(wù)、勞動(dòng)者的權(quán)利,且勞動(dòng)者所享有的該項(xiàng)權(quán)利在權(quán)能形式上表現(xiàn)為請(qǐng)求權(quán),需通過(guò)對(duì)方或他方協(xié)力方可實(shí)現(xiàn)。二是實(shí)踐上的創(chuàng)新,分為兩個(gè)部分,第一個(gè)部分是對(duì)于法律規(guī)定的分析,本文將現(xiàn)行勞動(dòng)法律法規(guī)中有關(guān)勞動(dòng)合同法定變更的規(guī)定進(jìn)行了梳理,歸納出法定變更的兩種類(lèi)型共十種情形,總結(jié)了法定變更需滿(mǎn)足書(shū)面變更的形式要件與雙方存在勞動(dòng)合同關(guān)系、變更事由符合法律規(guī)定、當(dāng)事人存在有效變更行及變更內(nèi)容明確四項(xiàng)實(shí)質(zhì)要件,并且雙方當(dāng)事人應(yīng)當(dāng)按照達(dá)成合意的程序進(jìn)行變更;第二個(gè)部分是關(guān)于法律后果的探討,在義務(wù)未得履行、變更的形式要件或?qū)嵸|(zhì)要件不滿(mǎn)足及程序違法等致使變更不成的情況下,當(dāng)事人需承擔(dān)何種法律后果。
[Abstract]:There is no systematic research on the legal change of labor contract in academic circles. There are few scholars who think that there are legal changes in labor law. This urges the author to study and interpret the legal change system of labor contract from the angle of theory and law. This paper focuses on the protection of the legitimate rights and interests of workers. A foothold. Starting from the basic legal theory of civil law and labor law, this paper analyzes how to understand and grasp the legal change system of labor contract, the key of which lies in two innovations. Based on the requirement of substantive justice, the concept of legal change of labor contract should exist, and the definition rules in logic are used to define the concept, and to discuss its legal nature and agreement. The characteristics of the multiple legal consequences and the sociality of the legislative purpose should be characterized as the obligation of the employer and the right of the laborer, and the right enjoyed by the laborer is manifested as the right of claim in the form of power. The second is the innovation in practice, which is divided into two parts, the first part is the analysis of the legal provisions. In this paper, the current labor laws and regulations on the statutory changes of labor contracts are combed, and two types of legal changes are summed up in ten situations. Summarized the legal changes to meet the formal requirements of written changes and the existence of labor contract relationship between the two parties, the change subject matter in accordance with the law, the parties to the effective change line and change content clear four essential elements. And the parties shall make changes in accordance with the agreed procedure; The second part is the discussion about the legal consequences. What kind of legal consequences should the parties bear if the obligation has not been fulfilled, the formal or substantive elements of the change are not satisfied and the procedure is illegal.
