【摘要】：在法治思想的影響下,國家刑罰權(quán)力運行的目的在于對犯罪行為進行打擊,以及對公民人身財產(chǎn)安全的保障。防衛(wèi)過當作為防衛(wèi)制度中的一個重要組成部分,對其處理不當必定會直接威脅到他人的生命安全,甚至影響到社會秩序的穩(wěn)定。在對防衛(wèi)過當進行定性的過程中,我們并不能夠直接套入具體罪名的犯罪構(gòu)成要件將其進行具體的定罪量刑,而《刑法》條文中用來規(guī)定防衛(wèi)過當行為的標準,包括行為主體的主觀方面、客觀方面、定罪處罰等各個方面也產(chǎn)生諸多理論爭議和實務(wù)處理的偏差。本文正是從這一基點出發(fā),論證成立防衛(wèi)過當?shù)闹�、客觀條件及其對防衛(wèi)過當定罪處罰的影響。本文共分為四部分,第一部分為問題的提出,該部分用相關(guān)案例引出關(guān)于認定防衛(wèi)過當存在的問題;第二部分對成立防衛(wèi)過當?shù)闹�、客觀條件進行分析,指出了認定防衛(wèi)過當?shù)某闪l件中容易被忽略之處;第三部分結(jié)合防衛(wèi)過當?shù)某闪l件,對防衛(wèi)過當進行定罪處罰;最后一部分在對全文做出理性思考的基礎(chǔ)上,提出筆者對防衛(wèi)制度的司法建議。
[Abstract]:Under the influence of the thought of the rule of law, the purpose of the operation of the state penalty power is to crack down on the criminal behavior, and to safeguard the personal and property safety of the citizen, as an important part of the defense system. Improper handling of it will directly threaten the safety of others and even affect the stability of social order. We can not directly cover the specific charges of the elements of the crime to carry out a specific conviction and sentencing, and the provisions of the Criminal Law are used to provide the standards for the defense of excessive conduct, including the subjective aspects of the subject of the act. Objective aspects, such as conviction and punishment also produce a lot of theoretical disputes and practical treatment of deviation. This article is from this point of view, to prove the establishment of the main body of excessive defense. Objective conditions and their impact on the conviction and punishment of excessive defense. This paper is divided into four parts, the first part is the question raised, this part uses the relevant cases to lead to the identification of the problem of excessive defense; The second part analyzes the subjective and objective conditions of establishing excessive defense, and points out that it is easy to be ignored in the establishment conditions of excessive defense. The third part combines the establishment condition of excessive defense, carries on the conviction punishment to the defense excessive; In the last part, on the basis of rational thinking on the full text, the author puts forward the judicial suggestions on the defense system.
