【摘要】:隨著我國住房制度改革,房地產(chǎn)業(yè)在我國踏入高速發(fā)展的軌道。住房制度經(jīng)過大幅度改革后,我國的住房逐步走向商品化、市場化。隨著住房商品化制度的推行,預(yù)售商品房制度應(yīng)運(yùn)而生,這種制度對于開發(fā)商和購房人都有好處:開發(fā)商可以提前獲得項(xiàng)目的啟動資金,緩解資金壓力;而購房人可以獲得較大的價格優(yōu)惠。但這也引起了開發(fā)商與購房人之間的房屋買賣過程的糾紛,特別是一房二賣現(xiàn)象屢禁不止。商品房開發(fā)商及中介受高額利益驅(qū)動,惡意違約。雖然國家己頒布相關(guān)法規(guī)及司法解釋,但一房二賣現(xiàn)象仍屢禁不止,嚴(yán)重?fù)p害買受人利益,對社會信譽(yù)造成嚴(yán)重的負(fù)面影響。從立法視角來看,雖然己頒布、實(shí)行涉及禁止一房二賣的法規(guī),但所涉法規(guī)條文籠統(tǒng),存在很多漏洞,可操作性較欠缺,使得商品房預(yù)售活動還不能完善解決。學(xué)術(shù)界己從應(yīng)該如何從立法角度使法律法規(guī)在懲處、禁止一房二賣事件中充分發(fā)揮作用進(jìn)行了相關(guān)研究,從司法實(shí)踐的效果來看,此方面的研究相對還有進(jìn)一步提高的空間;诖爽F(xiàn)狀,本文從一房二賣的現(xiàn)狀及存在問題、該現(xiàn)象的法律規(guī)制、一房二賣問題處理的完善等方面,逐步對該問題進(jìn)行了闡述和分析,并通過中外法律制度的比較提出了創(chuàng)新性的構(gòu)想,希望對該問題的解決能有所裨益。
[Abstract]:With the reform of housing system of our country, the real estate industry into the track of rapid development in our country. After the housing system greatly after the reform, China's housing market is gradually moving towards commercialization, with the commercialization of housing system reform, as the pre-sale of commercial housing system, this system for developers and buyers are good the start of the project: developers can obtain funds in advance, to ease the financial pressure; and the buyers can obtain greater price concessions. But it also caused the housing transactions between developers and buyers of the disputes, especially in a room two sell phenomenon repeated. Real estate developers and intermediaries by high profit driven, malicious breach of contract although countries have issued relevant laws and regulations and judicial interpretation, but a real two selling phenomenon is still repeated, serious damage to the interests of the buyer, caused a serious negative impact on social reputation. From the legislative view Angle of view, although has promulgated, implemented involving prohibited housing two sell regulations, but the legal provisions in general, there are many loopholes, lack of maneuverability, the advance sale of commercial housing is not perfect. The academic circles from how to from the angle of legislation to make laws and regulations in the punishment, prohibited a room two sell events give full play to the role of judicial practice from the point of view, the relative research in this area there is room for further improvement. Based on this situation, this article from the status of a room two sell and the problems of legal regulation of the phenomenon, and improve other aspects of a room two sell problem, step by step the problems are analyzed, and through the comparison of Chinese and foreign legal system put forward innovative ideas, hope to solve this problem and can be beneficial.
