【摘要】：黨的十八大提出了全面建成小康社會(huì)的奮斗目標(biāo),全面依法治國(guó)是實(shí)現(xiàn)這一目標(biāo)的戰(zhàn)略舉措,它為實(shí)現(xiàn)這一戰(zhàn)略目標(biāo)建立規(guī)則秩序,給予法律上的保證。人民政協(xié)的民主監(jiān)督屬于社會(huì)主義監(jiān)督體系中的黨外監(jiān)督,它對(duì)黨委、人大、政府及其他國(guó)家機(jī)關(guān)的工作進(jìn)行監(jiān)督。人民政協(xié)民主監(jiān)督作為我國(guó)社會(huì)主義監(jiān)督體系的重要組成部分,既是我國(guó)政治運(yùn)行程序中的重要環(huán)節(jié),又是人民行使監(jiān)督權(quán)利的重要形式,在我國(guó)民主政治生活中發(fā)揮著重要作用。人民政協(xié)的民主監(jiān)督是實(shí)現(xiàn)全面依法治國(guó)的重要途徑之一,以全面依法治國(guó)為視角,對(duì)人民政協(xié)民主監(jiān)督進(jìn)行深入研究,對(duì)于建設(shè)社會(huì)主義法治國(guó)家和全面建成小康社會(huì),具有重要的理論和現(xiàn)實(shí)意義。本文共分四部分:第一部分,全面依法治國(guó)視閾下人民政協(xié)民主監(jiān)督概述。這部分論述了全面依法治國(guó),其中包括依法治國(guó)的內(nèi)涵、全面依法治國(guó)的內(nèi)涵以及全面依法治國(guó)的要求。論述了人民政協(xié)民主監(jiān)督,其中包括人民政協(xié)的內(nèi)涵、人民政協(xié)民主監(jiān)督的內(nèi)涵、性質(zhì)、內(nèi)容、形式和特點(diǎn)以及人民政協(xié)民主監(jiān)督在國(guó)家治理中的作用。論述依法治國(guó)與人民政協(xié)民主監(jiān)督的關(guān)系。全面依法治國(guó)是人民政協(xié)民主監(jiān)督的重要保障,人民政協(xié)民主監(jiān)督是全面依法治國(guó)的重要政治資源。第二部分,全面依法治國(guó)視閾下人民政協(xié)民主監(jiān)督的意義和機(jī)遇。這部分主要論述了全面依法治國(guó)視閾下人民政協(xié)民主監(jiān)督推進(jìn)我國(guó)社會(huì)主義民主政治建設(shè),有利于全民踐行依法治國(guó)建設(shè)社會(huì)主義法治國(guó)家,助推社會(huì)主義監(jiān)督體系的完善這三大意義;以及良好的監(jiān)督環(huán)境、不斷完善的監(jiān)督制度體系和日益增強(qiáng)的監(jiān)督意識(shí)等機(jī)遇。第三部分,全面依法治國(guó)對(duì)人民政協(xié)民主監(jiān)督的時(shí)代述求。這部分論述了人民政協(xié)的民主監(jiān)督必須堅(jiān)持中國(guó)共產(chǎn)黨的領(lǐng)導(dǎo);與人大監(jiān)督、黨內(nèi)監(jiān)督等形成監(jiān)督合力,加強(qiáng)對(duì)司法活動(dòng)和行政權(quán)力的監(jiān)督來(lái)強(qiáng)化人民政協(xié)的監(jiān)督力度;人民政協(xié)要領(lǐng)導(dǎo)本單位遵守憲法法律和堅(jiān)決查處本單位違法違紀(jì)行為來(lái)加強(qiáng)人民政協(xié)的內(nèi)部管理。第四部分,全面依法治國(guó)視閾下加強(qiáng)人民政協(xié)民主監(jiān)督的路徑。這部分提出了增強(qiáng)政協(xié)委員的民主監(jiān)督意識(shí)、法律意識(shí)、法律思維、監(jiān)督為民的意識(shí),黨員干部自覺(jué)接受監(jiān)督的意識(shí)來(lái)增強(qiáng)全面依法治國(guó)視閾下人民政協(xié)民主監(jiān)督意識(shí);加強(qiáng)人民政協(xié)內(nèi)部法規(guī)制度建設(shè)、完善人民政協(xié)民主監(jiān)督相關(guān)法律法規(guī)來(lái)完善全面依法治國(guó)視閾下人民政協(xié)民主監(jiān)督法制體系;保證言路暢通、健全人民政協(xié)民主監(jiān)督機(jī)制,補(bǔ)充評(píng)判標(biāo)準(zhǔn)、完善人民政協(xié)民主監(jiān)督機(jī)制和善加利用網(wǎng)絡(luò)監(jiān)督提高人民政協(xié)民主監(jiān)督效率來(lái)健全全面依法治國(guó)視閾下人民政協(xié)民主監(jiān)督機(jī)制體系。
[Abstract]:The eighteen Party's proposed building a well-off society goal, a comprehensive rule of law is a strategic measure to achieve this goal, it establish the rules of order to achieve this strategic goal, given the legal guarantee of democratic supervision of the CPPCC. Belongs to the non party supervision system of socialist supervision, it to the Party committee, people's Congress, the government and other state organs to supervise the work of the CPPCC's democratic supervision. As an important part of China's socialism supervision system, an important part of China's political program is in operation, is an important form of people's exercise of supervision right, play an important role in China's political life in the democratic supervision of the CPPCC. Is one of the important ways to realize fully the rule of law, the rule of law from the perspective of a comprehensive, in-depth study of the CPPCC's democratic supervision, for the construction of socialist law Rule the country and building a well-off society, has important theoretical and practical significance. This paper is divided into four parts: the first part, from the perspective of comprehensive law of CPPCC's democratic supervision. In the third part, the era of comprehensive law CPPCC democratic supervision.
