【摘要】：在我國城市化進程中,由于流動攤販自由度高、門檻低、成本低、可操作性強,很多失業(yè)人口及農村剩余勞動力等弱勢群體都通過街頭擺攤來維持生存。因此,幾乎每個城市都有一定的流動攤販存在。目前管理流動攤販的職責主要是由各地城市管理部門來承擔,一直以來,流動攤販與城市管理行政執(zhí)法(以下簡稱"城管執(zhí)法")人員的沖突和矛盾不斷,而攤販"占道經營"現(xiàn)象卻未得到有效治理,浪費了大量的行政成本。如何破解城管執(zhí)法困境,實現(xiàn)有效的攤販治理,是構建文明社會、和諧社會、法治社會的關鍵因素。本文從城市流動攤販治理的視角,分析城管執(zhí)法過程中遭遇的城市管理法律法規(guī)不健全、城管執(zhí)法沖突不斷、攤販治理理念偏頗、城管執(zhí)法對象和環(huán)境的復雜性、城管執(zhí)法負面形象根深蒂固等方面的困境,運用文獻分析法、實地訪談法、對比分析法等多種方法,利用新公共管理理論、馬斯洛需求理論等多種理論,并通過借鑒國內外關于攤販管理的先進經驗,研究給出了加快城市管理專項立法實施、健全城管執(zhí)法體制、改進城市管理理念、創(chuàng)新城管執(zhí)法方式、加大媒體正面宣傳并建立公眾參與等幾個方面的對策和建議,尤其是城管執(zhí)法"721"(70%的問題用服務手段解決,20%的問題用管理手段解決,10%的問題用執(zhí)法手段解決)創(chuàng)新工作機制的提出,促進基層一線城管執(zhí)法人員執(zhí)法理念的轉變,通過加強城市服務妥善地解決流動攤販治理的問題。
[Abstract]:In the process of urbanization in China, because of the high degree of freedom of mobile vendors, low threshold, low cost, strong operability, many unemployed people and rural surplus labor force and other vulnerable groups through street stalls to survive. There are some mobile vendors in almost every city. At present, the responsibility of managing mobile vendors is mainly undertaken by the local urban management departments, has been. The conflicts and contradictions between the mobile vendors and the urban administrative law enforcement personnel (hereinafter referred to as "urban management law enforcement") are constant, but the phenomenon of "Occupy operation" of vendors has not been effectively managed. Waste a large number of administrative costs. How to solve the plight of urban management law enforcement, to achieve effective vendor governance, is the construction of a civilized society, a harmonious society, the rule of law society. This article from the perspective of urban mobile vendors governance. Analysis of urban management law enforcement encountered in the process of urban management laws and regulations are not perfect, urban management law enforcement conflicts, vendors management concept bias, urban management law enforcement object and the complexity of the environment. The dilemma of the negative image of urban management law enforcement is deep-rooted, the use of literature analysis, field interviews, comparative analysis and other methods, the use of new public management theory, Maslow demand theory and other theories. And through drawing lessons from domestic and foreign advanced experience on the management of vendors, this paper studies and puts forward to accelerate the implementation of special legislation on urban management, improve the law enforcement system of urban management, improve the concept of urban management, and innovate the way of urban management law enforcement. We should increase the positive publicity of the media and establish some countermeasures and suggestions for public participation. In particular, 70% of the problems of urban management law enforcement "721" or "721"% of the problems will be solved by service means, and 20% of the problems will be solved by the means of management. The 10% problem is solved by law enforcement means) the innovation work mechanism is put forward to promote the change of the law enforcement idea of the urban management law enforcement personnel at the grass-roots level, and to solve the problem of the management of mobile vendors properly by strengthening the city service.
