【摘要】:近年來,隨著民營經(jīng)濟及中小企業(yè)的快速發(fā)展,民間借貸呈現(xiàn)出了一片空前繁榮的景象,其迅速發(fā)展不但緩解了中小企業(yè)的資金需求,也促進了我國經(jīng)濟與社會的發(fā)展;但是,由于長期以來,民間借貸法律監(jiān)管缺失,民間借貸弊端叢生,民間借貸危機也接二連三的發(fā)生;2011年,一場“高利貸崩盤”,“私營企業(yè)老板欠債跑路”的焦點新聞事件,更是將民間借貸從幕后催上了前臺,受到了全社會的廣泛關(guān)注,加強對民間借貸的法律監(jiān)管已是刻不容緩,這不但是民間的迫切要求,也是政府著手要解決的重大經(jīng)濟、社會問題。2011年十一期間,國務(wù)院總理溫家寶在溫州調(diào)研時,就指出民間借貸要規(guī)范管理,防范風(fēng)險,以促使它健康發(fā)展。因此,對民間借貸已不是要不要合法,要不要法律監(jiān)管的問題,而是怎么合法化,怎么監(jiān)管的問題,以興利除弊,引導(dǎo)和規(guī)范民間借貸的發(fā)展,從而更好的推動中國經(jīng)濟和社會的進一步發(fā)展。 本文緒論部分簡要敘述了現(xiàn)有的研究成果、本文的研究價值、創(chuàng)新點以及研究方法。 第一章從厘清民間借貸的概念入手,分析了我國民間借貸的現(xiàn)狀,對民間借貸的發(fā)展階段進行了簡要的闡述,對民間借貸發(fā)展中出現(xiàn)的新特點、新趨勢進行了全面的歸納和總結(jié),對民間借貸存在的合理性從資金供求、民間借貸本身的特點、現(xiàn)行農(nóng)村社會的特點三個方面進行了有力的論證。 在對民間借貸要不要進行法律監(jiān)管的問題上,第二章論證了民間借貸法律監(jiān)管的必要性。民間借貸缺乏法律監(jiān)管,其弊端日益顯現(xiàn),克服民間借貸的弊端有必要對民間借貸進行法律監(jiān)管。 第三章對民間借貸法律監(jiān)管的現(xiàn)狀進行了梳理,對監(jiān)管存在的問題進行了闡釋。首先,我國金融監(jiān)管法律雖不少,但民間借貸監(jiān)管的專門法律缺失,民間借貸監(jiān)管無法可依。其次,民間借貸長期游走于法律的邊緣,法律監(jiān)管問題重重,不但監(jiān)管法律缺失,也無明確的監(jiān)管機構(gòu)和監(jiān)管程序;在監(jiān)管中,重合規(guī)性監(jiān)管,風(fēng)險掌控能力不強。 第四章確定了我國民間借貸法律監(jiān)管的基本思路。確立了效率與公平統(tǒng)籌兼顧和自由與秩序和諧統(tǒng)一的監(jiān)管理念,強調(diào)采用合規(guī)監(jiān)管與風(fēng)險監(jiān)管相結(jié)合的監(jiān)管模式;在監(jiān)管手段上,應(yīng)多管齊下,注重事前監(jiān)管,并確立了公平、公正、公開,審慎,協(xié)調(diào)等監(jiān)管原則。 第五章提出了建構(gòu)我國民間借貸法律監(jiān)管制度的具體建議。首先在基本法律制度方面,,一是建立、完善民間借貸的相關(guān)法律、法規(guī),二是放寬利率管制,三是建立規(guī)范的民間借貸法律監(jiān)管機制,四是加強市場監(jiān)測,五是支持小額貸款公司和社區(qū)、村鎮(zhèn)銀行的發(fā)展。其次,在配套機制方面,一是應(yīng)成立行業(yè)協(xié)會,加強行業(yè)自律性監(jiān)管;二是建立存款保險制度;三是建立社會征信體系,為民間借貸供需雙方構(gòu)建客觀、公正的社會征信平臺;四是加大對民間金融的財政、稅收支持力度。
[Abstract]:In recent years, with the rapid development of private economy and small and medium-sized enterprises, private lending presents a piece of unprecedented prosperity, the rapid development of not only alleviate the funding needs of SMEs, but also promote the development of China's economy and society; however, for a long time, the lack of legal supervision of private lending, private lending problems disadvantages of private lending crisis happened one after another; in 2011, a "usury crash", "the owner of the private sector debt run away" the focus of news events, is borrowing from behind the rush on the stage, there is a widespread concern of the whole society, strengthen the legal supervision of private lending is imperative, this but not folk urgent need, also is the government with major economic to solve social problems during the period of eleven years,.2011, Premier Wen Jiabao in Wenzhou research, pointed out that private lending to Standardized management, risk prevention, to promote its healthy development. Therefore, the private lending has not want to legitimate or legal regulation, but how to legalize, how regulatory issues, to promote, guide and standardize the development of private lending, so as to better promote the further development of economic and social China.
The introduction of this article briefly describes the existing research results, the value of the research, the innovation and the research methods.
The first chapter starts from clarifying the concept of private lending, analyzes the status quo of China's private lending, the development of private lending stages are discussed, the new characteristics in the development of private lending, the new trend of the comprehensive summary of the rationality of the existence of private lending from the supply and demand of funds, the characteristics of private lending the three characteristics of current rural community was a strong argument.
On the issue of whether private lending is regulated by law, the second chapter demonstrates the necessity of legal supervision of private lending. Private lending lacks legal supervision, and its disadvantages are becoming increasingly apparent. Overcoming the drawbacks of private lending is necessary for legal supervision of private lending.
The third chapter summarizes the status quo of the legal supervision of private lending, the regulatory problems are explained. First, China's financial supervision and legal althoughmany, but the lack of specialized legal private lending regulation, private lending regulatory no laws. Secondly, private lending long walk to the edge of the law, legal and regulatory problems, not only the lack of legal regulation, no clear regulatory agencies and regulatory procedures; in supervision, coincidence compliance supervision, risk control ability.
The fourth chapter defines the basic ideas of China's private lending legal supervision. To establish the efficiency and fairness into consideration and harmonious unity of freedom and order of the regulatory philosophy, emphasize the compliance supervision and risk supervisioncombined supervision mode; in the regulatory means, should be multi pronged approach, focusing on the prior supervision, and to establish a fair, impartial, open, prudent coordinationand supervision principles.
The fifth chapter puts forward concrete suggestions to establish the regulatory system of private lending laws in our country. At first, the basic legal system, one is to establish and improve relevant laws and regulations of private lending, the two is the deregulation of interest rates, the three is to establish a standard private lending legal supervision mechanism, four is to strengthen market monitoring, five is to support small loan the company and the community, the development of the rural banks. Secondly, in the supporting mechanism, one should set up industry associations, strengthen industry self-discipline supervision; two is the establishment of deposit insurance system; the three is the establishment of social credit system, private lending for both supply and demand of construction objective, impartial social credit platform; the four is to increase the folk finance fiscal and tax support.
