【摘要】：隨著社會(huì)經(jīng)濟(jì)不斷發(fā)展和人們思想不斷解放,公眾對(duì)婚姻的認(rèn)識(shí)呈現(xiàn)多樣化,對(duì)同居的接受程度越來(lái)越高。隨之,非婚同居在這種社會(huì)大環(huán)境下發(fā)展起來(lái),尤其是到二十世紀(jì)九十年代迅速流行起來(lái)。非婚同居關(guān)系既滿足了人們自由選擇生活方式的要求,又緩解了現(xiàn)實(shí)婚姻帶來(lái)的資金壓力。但是,隨著非婚同居的不斷發(fā)展,該現(xiàn)象也引起了諸多社會(huì)問(wèn)題,應(yīng)給予充分的重視。另外,在中國(guó)民法學(xué)研究會(huì)2016年年會(huì)上,徐滌宇教授提出在民法典編纂過(guò)程中要對(duì)不斷發(fā)展的非婚同居現(xiàn)象給予重視,非婚同居現(xiàn)象再次引起大家的注意。借著民法典編纂的契機(jī),為了適應(yīng)非婚同居的發(fā)展要求并解決由其引起的諸多社會(huì)問(wèn)題,通過(guò)法律對(duì)其進(jìn)行規(guī)制成為亟需解決的問(wèn)題。在非婚同居法律規(guī)制問(wèn)題上,我國(guó)雖然取得了一些進(jìn)展,但是仍然有很多問(wèn)題亟待解決�，F(xiàn)今,在立法上,我國(guó)法律對(duì)非婚同居問(wèn)題仍采取一種“不承認(rèn),不支持,不干預(yù)”回避的態(tài)度,并沒(méi)有給予明確規(guī)定;在司法上,我國(guó)最高人民法院雖然出臺(tái)了相關(guān)意見(jiàn)和司法解釋,但是依然存在很多漏洞和不足。通過(guò)運(yùn)用價(jià)值分析法、比較分析法、歷史分析法的研究方法,我們充分論述我國(guó)非婚同居法律規(guī)制立法和司法現(xiàn)狀,從而找出在立法和司法上存在的一系列問(wèn)題。找出問(wèn)題的最終目的是解決問(wèn)題。針對(duì)非婚同居法律規(guī)制立法和司法所存在的問(wèn)題,借著民法典編纂的契機(jī),我們創(chuàng)新性的提出非婚同居法律規(guī)制的立法和司法建議,期待更好的解決非婚同居所引起的矛盾糾紛。針對(duì)如何解決非婚同居法律規(guī)制所面臨的問(wèn)題,我們可以從立法和司法兩方面具體提出解決方案。在立法上,我們要緊緊抓住民法典編纂的機(jī)遇并順應(yīng)社會(huì)發(fā)展的需要,將非婚同居寫(xiě)入民法典,建立完善的非婚同居法律制度。該法律制度要對(duì)非婚同居的成立、人身關(guān)系、財(cái)產(chǎn)關(guān)系、親子關(guān)系和非婚同居的解除等方面進(jìn)行明確規(guī)定,從而把非婚同居列入到法律規(guī)制范圍內(nèi),為解決非婚同居所引發(fā)的問(wèn)題提供法律依據(jù)。在司法上,我國(guó)要出臺(tái)一系列司法解釋和指導(dǎo)性案例,并加強(qiáng)對(duì)弱勢(shì)群體的保護(hù)力度。通過(guò)落實(shí)這些司法措施,在司法領(lǐng)域,我們可以更好的對(duì)非婚同居進(jìn)行法律規(guī)制。我國(guó)將非婚同居納入法律規(guī)制的范圍內(nèi),順應(yīng)了社會(huì)發(fā)展的要求,既可以保護(hù)非婚同居者雙方的利益,又可以解決非婚同居所面臨的一系列問(wèn)題。期待該研究能對(duì)非婚同居法律規(guī)制有所貢獻(xiàn)。
[Abstract]:With the continuous development of social economy and the continuous liberation of people's thoughts, the public's understanding of marriage is diversified, and the acceptance of cohabitation is getting higher and higher. As a result, unmarried cohabitation has developed in this social environment, especially in 1990s. The unmarried cohabitation not only satisfies the demands of people's free choice of life style, but also relieves the financial pressure brought by real marriage. However, with the continuous development of non marital cohabitation, this phenomenon has also caused many social problems, and should be given full attention. In addition, at the 2016 annual meeting of China Civil Law Research Association, Professor Xu Diyu proposed that we should pay attention to the phenomenon of unmarried cohabitation in the process of compiling the civil code, and the phenomenon of unmarried cohabitation attracted everyone's attention again. With the opportunity of compiling the civil code, in order to adapt to the development requirement of unmarried cohabitation and solve many social problems caused by it, it is urgent to regulate it by law. Although some progress has been made in the legal regulation of unmarried cohabitation, there are still a lot of problems to be solved. Now, in the legislation, the law of our country is still unmarried cohabitation problems take a "do not admit, do not support non intervention" evasive attitude, and did not give clear; in judicial practice, the Supreme People's Court of China has introduced some relevant opinions and judicial interpretation, but there are still many loopholes and shortcomings. By using the research methods of value analysis, comparative analysis and historical analysis, we fully discuss the current situation of legislation and judicial regulation of unmarried cohabitation in China, so as to find a series of problems in legislation and judicature. The ultimate goal of finding out the problem is to solve the problem. Aiming at the existing problems of legislation and judicature in the regulation of unmarried cohabitation, by innovating the legislative and judicial suggestion of the legal regulation of unmarried cohabitation, we hope to better solve the contradictions and disputes caused by unmarried cohabitation. In view of how to solve the problems faced by the legal regulation of unmarried cohabitation, we can put forward the solutions from two aspects of legislation and judicature. In legislation, we must seize the opportunity of compiling the civil code and comply with the needs of social development. We will integrate the unmarried cohabitation into the civil code, and establish a perfect unmarried cohabitation legal system. The legal system should be established for unmarried cohabitation, personal relations, property relations, parent-child relationship and cohabitation termination etc. were clearly defined, so the scope of legal regulation of unmarried cohabitation in, provide a legal basis for solving the problems caused by non marital cohabitation. In the judiciary, our country should introduce a series of judicial interpretations and guiding cases, and strengthen the protection of the vulnerable groups. Through the implementation of these judicial measures, in the field of justice, we can better regulate the law of non marriage cohabitation. China's incorporation of unmarried cohabitation into the scope of legal regulation complies with the requirements of social development. It can not only protect the interests of the unmarried cohabitation, but also solve a series of problems faced by unmarried cohabitation. It is expected that the study will contribute to the legal regulation of unmarried cohabitation.
