【摘要】：海外華僑因其具有“海外關(guān)系”的特性[1],成為我國經(jīng)濟(jì)和文化發(fā)展以及祖國統(tǒng)一的重要推動力量。[2]在恐怖主義襲擊、跨國走私犯罪等非傳統(tǒng)安全威脅問題日益嚴(yán)峻的現(xiàn)況下,海外華僑權(quán)益受損害的情況時有發(fā)生。我國憲法明確規(guī)定保障華僑正當(dāng)?shù)臋?quán)利和利益,但目前我國對海外華僑權(quán)益保障在理論研究、法制和實(shí)踐層面都存有不少問題,難以滿足其保障需求。隨著“一帶一路”政策的推廣,海外華僑的群體人數(shù)必然會快速增長,如何保障其權(quán)利和利益顯得愈發(fā)重要。本文基于此研究海外華僑權(quán)益保障的現(xiàn)狀及問題,并提出建議。文章分為四章。第一章對相關(guān)概念、理論進(jìn)行概述。先界定海外華僑、歸僑、僑眷、外籍華人、海外中國公民的概念。然后闡述海外華僑權(quán)益保障的內(nèi)容。第二章介紹了非傳統(tǒng)安全的概念并分析了海外華僑面臨的具體非傳統(tǒng)安全威脅因素;然后主要論述海外華僑權(quán)益保障在非傳統(tǒng)安全背景下的現(xiàn)狀,即領(lǐng)事保護(hù)發(fā)揮著重要作用,外交保護(hù)較少被使用以及護(hù)僑難度變大也可以理解為特征。第三章從理論、法制和實(shí)踐這三方面重點(diǎn)展開論述海外華僑權(quán)益保障的問題:一是理論研究缺乏,二是華僑權(quán)益保護(hù)法律依據(jù)不足,三是實(shí)踐中存在的問題。并重點(diǎn)論述了法制層面存在的“立法形式存有爭議、現(xiàn)有法律規(guī)定不完善、配套國內(nèi)法規(guī)缺失以及領(lǐng)事條約簽訂少和《公民權(quán)利和政治權(quán)利國際公約》未批準(zhǔn)”的具體問題。第四章針對問題提出完善海外華僑權(quán)益保障的具體建議。一要加強(qiáng)對海外華僑權(quán)益保障的理論研究。二要在選擇一般的立法形式下完善國內(nèi)現(xiàn)有的相關(guān)法律,推動領(lǐng)事保護(hù)和外交保護(hù)立法工作,加快簽訂雙邊領(lǐng)事保護(hù)協(xié)定工作等。三要加大涉外法律宣傳教育力度并加強(qiáng)海外華僑相關(guān)數(shù)據(jù)的統(tǒng)計工作,完善華僑權(quán)益保障工作。
[Abstract]:Overseas Chinese have become an important driving force for China's economic and cultural development and the reunification of the motherland because of its [1] characteristics of "overseas relations". In the increasingly serious situation of non-traditional security threats such as terrorist attacks and transnational smuggling, [2] has been damaged by overseas Chinese rights and interests. China's Constitution clearly stipulates that the rights and interests of overseas Chinese are guaranteed, but at present, there are many problems in China's rights and interests protection for overseas Chinese in terms of theoretical research, legal system and practice, which are difficult to meet their security needs. With the promotion of "The Belt and Road" policy, the number of overseas Chinese groups will grow rapidly, how to become more and more important to protect their rights and interests. This paper is based on the study of the status and problems of overseas Chinese rights and interests, and puts forward some suggestions. The article is divided into four chapters. In the first chapter, the relevant concepts and theories are summarized. First define the concept of overseas Chinese, returned overseas Chinese, overseas Chinese and overseas China citizens. Then it expounds the content of the rights and interests of overseas Chinese. The second chapter introduces the concept of non-traditional security and analyzes the non-traditional security threats facing overseas; and then discusses the protection of the rights and interests of overseas Chinese status in non-traditional security under the background of the consular protection plays an important role in the diplomatic protection is less and the protection of overseas Chinese is difficult to understand the characteristics of can. The third chapter focuses on the three aspects of theory, legal system and practice, and discusses the protection of overseas Chinese rights and interests: first, the lack of theoretical research; two, the lack of legal basis for the protection of overseas Chinese rights and interests; three, the problems in practice. It also focuses on the existing problems in the legal system, such as the controversial form of legislation, the imperfection of the existing laws and regulations, the lack of relevant domestic laws and regulations, and the specific problems of the signing of the Treaty of consular treaty and the unauthorized ratification of the International Covenant on Civil and political rights. The fourth chapter puts forward specific suggestions on improving the rights and interests of overseas Chinese. First, we should strengthen the theoretical research on the protection of the rights and interests of overseas Chinese. Two, we should improve our existing laws in the general legislative form, promote consular protection and diplomatic protection legislation, and accelerate the signing of bilateral consular protection agreements. Three we should strengthen the publicity and education of foreign law and strengthen the statistical work of overseas Chinese related data so as to improve the protection of the rights and interests of overseas Chinese.
