【摘要】：本文立足于我國(guó)司法實(shí)踐中的三個(gè)典型案例,并結(jié)合我國(guó)探望權(quán)制度的既有立法,運(yùn)用系統(tǒng)分析和比較分析的方法,在前人研究成果的基礎(chǔ)之上,分三部分對(duì)探望權(quán)制度進(jìn)行論述。第一部分是提出問(wèn)題。本部分通過(guò)三個(gè)探望權(quán)典型案例揭露我國(guó)探望權(quán)立法中存在的不足和缺陷,從探望權(quán)的主體、中止、內(nèi)容和強(qiáng)制執(zhí)行方面論述我國(guó)探望權(quán)制度存在的不足,主要包括探望權(quán)主體過(guò)于狹窄、探望中止事由規(guī)定不夠詳盡、權(quán)利義務(wù)內(nèi)容不明確和強(qiáng)制執(zhí)行規(guī)定過(guò)于原則,可操作性不強(qiáng),總結(jié)出其根本原因是制度設(shè)計(jì)脫離了子女最大利益這個(gè)立法宗旨。為后文進(jìn)一步的論述提供實(shí)踐基礎(chǔ)。第二部分是關(guān)于探望權(quán)法理基礎(chǔ)透析。首先闡釋了探望權(quán)的概念和探望權(quán)與親權(quán)的關(guān)系,并對(duì)探望權(quán)法律關(guān)系作出了剖析;其次,闡釋了婚姻法學(xué)界關(guān)于探權(quán)性質(zhì)的討論,包括探望權(quán)權(quán)利說(shuō)、義務(wù)說(shuō)和權(quán)利義務(wù)兼?zhèn)湔f(shuō),接著筆者對(duì)探望權(quán)權(quán)利義務(wù)歸屬作出了自己相應(yīng)的評(píng)析;最后,從探望權(quán)制度的功能和必要性兩方面闡明了探望權(quán)的制度價(jià)值。第三部分是關(guān)于我國(guó)探望權(quán)制度的立法完善。本部分針對(duì)第一部分提出的問(wèn)題與不足,有的放矢的提出了完善我國(guó)探望權(quán)的立法建議。倡導(dǎo)合理拓寬探望權(quán)的權(quán)利主體范圍,并使探望權(quán)中止事由法定化,明確和細(xì)化探望權(quán)權(quán)利義務(wù)具體內(nèi)容,健全探望權(quán)強(qiáng)制執(zhí)行救濟(jì)機(jī)制,從而進(jìn)一步完善我國(guó)探望權(quán)立法,更加有效的保護(hù)父母與未成年子女的利益。
[Abstract]:Based on three typical cases in China's judicial practice, combined with the existing legislation of visitation rights system in our country, based on previous research results, we have discussed the visitation system in three parts by using the methods of systematic analysis and comparative analysis. The first part is the question. This part through three typical cases to expose the visitation right in China has visitation rights legislation shortcomings and defects, from the subject of visitation right suspension, content and enforcement aspects of the visitation right system deficiencies, including the subject of visitation right is too narrow, visit in check stipulated content is not exhaustive, rights and obligations no clear and enforceable provisions are too principle, operability is not strong, summed up its basic reason is the system design from the best interests of the child the legislative purpose. It provides a practical basis for further discussion. The second part is about the dialysis of the legal basis of the right of visitation. First explains the concept of visitation rights and visitation rights and parental relationship, and made analysis on the legal relationship of visitation rights; secondly, explains the discussion about exploration of the nature of the right to marriage law, visitation rights, including both obligations and rights and obligations, then the author to see the ownership of the rights and obligations of their own the corresponding evaluation; finally, from the system of visitation right necessity and function two aspects illustrates the value of the system of visitation right. The third part is about the legislative perfection of the visitation right system in China. In view of the problems and shortcomings in the first part, the legislative proposals to improve the visitation right of our country are put forward with a definite aim. Advocate reasonable to broaden the scope of visitation rights, and the suspension of visitation of statutory grounds, clarify and refine the visitation rights and obligations of the specific content, improve the enforcement of visitation right relief mechanism, to further improve the legislative right to visit China, parents more effective and protect the interests of minor children.
