環(huán)境行政公益訴訟的原告主體資格研究

【摘要】:環(huán)境在任何時(shí)候都是人類生存和發(fā)展的基礎(chǔ),尤其是近幾年,我國(guó)經(jīng)濟(jì)發(fā)展取得了巨大成就,但是,與之相伴隨的是環(huán)境生態(tài)惡化、環(huán)境資源短缺等環(huán)境問題。隨著公眾的環(huán)境保護(hù)意識(shí)和法律意識(shí)的覺醒和不斷加強(qiáng),環(huán)境公益訴訟這一致力于保護(hù)環(huán)境公共利益為目的的訴訟制度便有了存在的必要性和價(jià)值。近年來(lái),關(guān)于環(huán)境公益訴訟的理論研究不斷深入,司法實(shí)務(wù)也積極探索,使環(huán)境公益訴訟制度不斷完善。這里所說的環(huán)境公益訴訟制度,不僅包括環(huán)境民事公益訴訟,也包括環(huán)境行政公益訴訟。因?yàn)樵斐森h(huán)境污染的不止是一些企業(yè),行政機(jī)關(guān)的具體行政行為和抽象行政行為都有可能造成對(duì)環(huán)境公益的侵害。本文所探討的內(nèi)容,正是由于行政機(jī)關(guān)的違法行政行為或者不作為而造成的環(huán)境公益損害,應(yīng)該由誰(shuí)提起訴訟的問題。雖然目前我國(guó)環(huán)境行政公益訴訟還未納入行政訴訟法中,但是一項(xiàng)訴訟制度的建立,原告主體資格的明確是最基礎(chǔ)的前提,這樣才能使各原告主體在法律的框架內(nèi)行使訴訟權(quán)利,也才能使這項(xiàng)制度有進(jìn)一步發(fā)展和完善的可能性。本文在前人對(duì)環(huán)境公益訴訟以及行政公益訴訟的研究基礎(chǔ)之上,結(jié)合當(dāng)前涉及環(huán)境行政公益訴訟的相關(guān)規(guī)定和司法實(shí)踐活動(dòng),對(duì)我國(guó)環(huán)境行政公益訴訟的原告主體資格提出了新思路。本文包括以下內(nèi)容:第一章,環(huán)境行政公益訴訟原告主體資格概述。該部分首先是對(duì)環(huán)境行政公益訴訟與環(huán)境公益訴訟以及行政公益訴訟的辨析,理清楚其中的隸屬關(guān)系,得出環(huán)境行政公益訴訟的原告主體資格應(yīng)當(dāng)具有環(huán)境公益訴訟和行政公益訴訟的共性,后文的論述都是在此基礎(chǔ)上展開的。其次,主要通過與傳統(tǒng)行政訴訟法上原告主體資格的對(duì)比,分析環(huán)境行政公益訴訟中原告主體資格的特殊性,進(jìn)而分析確立環(huán)境行政公益訴訟中原告資格的必要性,并希望能從理論中找到合理的依據(jù)。第二章,環(huán)境行政公益訴訟原告主體資格的現(xiàn)狀及問題。該部分列舉了我國(guó)目前涉及到環(huán)境行政公益訴訟原告主體資格的一些立法規(guī)定,以及司法實(shí)踐中對(duì)于環(huán)境行政公益訴訟原告主體資格的有益探索,然后從這些規(guī)定和實(shí)踐案例中梳理出目前存在的幾大問題。第三章,國(guó)外環(huán)境公益訴訟原告資格的相關(guān)立法和司法實(shí)踐。通過對(duì)域外相關(guān)立法和司法實(shí)踐的發(fā)展演變過程及具體適用條件的分析,從中得到一些具體的啟示和經(jīng)驗(yàn)。第四章,我國(guó)環(huán)境行政公益訴訟原告主體資格的完善。該部分是針對(duì)第二部分提到的問題提出自己的完善建議。既有立法上的建議,也有針對(duì)不同主體提出的司法上的建議。
[Abstract]:The environment is the foundation of human survival and development at all times, especially in recent years, the economic development of our country has made great achievements, but with it is accompanied by the deterioration of the environment and ecology. Environmental problems such as shortage of environmental resources. With the awakening and strengthening of public awareness of environmental protection and legal consciousness, Environmental public interest litigation, a litigation system dedicated to the protection of environmental public interests, has the necessity and value of existence. In recent years, the theoretical research on environmental public interest litigation has been deepened, and judicial practice has been actively explored. Make the system of environmental public interest litigation continuously perfect. The environmental public interest litigation system referred to here includes not only environmental civil public welfare litigation, but also environmental administrative public welfare litigation. Because it is not only some enterprises that cause environmental pollution, The specific administrative acts and abstract administrative acts of administrative organs may cause damage to the environmental public welfare. The contents discussed in this paper are precisely the environmental public welfare damage caused by the illegal administrative acts or omission of the administrative organs. Although the environmental administrative public interest litigation in our country has not been included in the administrative litigation law at present, the establishment of a litigation system and the determination of the plaintiff's subject qualification are the most basic premise. Only in this way can the plaintiff subject exercise the litigation rights within the framework of the law, and make this system possible to further develop and perfect. This paper is based on the previous researches on environmental public interest litigation and administrative public interest litigation. Combined with the relevant regulations and judicial practice of environmental administrative public interest litigation, this paper puts forward a new way of thinking about the plaintiff's qualification of environmental administrative public interest litigation in our country. This article includes the following contents: chapter one, The first part is to distinguish environmental administrative public interest litigation from environmental public interest litigation and administrative public interest litigation, and to clarify the subordinate relationship among them. It is concluded that the subject qualification of plaintiff in environmental administrative public interest litigation should have the commonness of environmental public interest litigation and administrative public interest litigation. This paper analyzes the particularity of plaintiff's qualification in environmental administrative public interest litigation by comparing it with the qualification of plaintiff in traditional administrative litigation law, and then analyzes the necessity of establishing plaintiff's qualification in environmental administrative public interest litigation. And hope to find a reasonable basis from the theory. The second chapter, environmental administrative public interest litigation plaintiff qualification status and problems. This part lists some legislative provisions concerning the subject qualification of environmental administrative public interest litigation in our country. And in the judicial practice for the environmental administrative public interest litigation plaintiff qualification of the beneficial exploration, and then from these provisions and practical cases to sort out the existing problems. Chapter three, Relevant legislation and judicial practice of plaintiff qualification in foreign environmental public interest litigation. Through the analysis of the development and evolution process and specific application conditions of foreign relevant legislation and judicial practice, some specific enlightenment and experience are obtained from it. Chapter 4th, The perfection of plaintiff's qualification in environmental administrative public interest litigation in our country. This part is to put forward own perfect suggestion in view of the problems mentioned in the second part. There are legislative suggestions as well as judicial suggestions for different subjects.
