【摘要】：礦產(chǎn)資源需求量增大與采礦用地指標(biāo)分配不足之間的矛盾日益加劇。緩解這一矛盾,制定合理的采礦用地制度是解決這一問題的關(guān)鍵。根據(jù)實(shí)際需求建立有效合理的采礦用地供應(yīng)方式,在“礦-地”矛盾推動(dòng)下國家推進(jìn)采礦用地改革試點(diǎn),在部分礦區(qū)實(shí)施采礦用地改革供地方式,本文從采礦用地改革制度政策研究出發(fā),總結(jié)該用地方式下出現(xiàn)的問題以及探討采礦用地改革用地方式的適用范圍,為完善采礦用地制度改革提出政策建議。這對(duì)我國礦產(chǎn)資源的開發(fā)與利用,土地資源的合理配置以及可持續(xù)利用具有重要意義。論文首先對(duì)采礦用地、采礦用地改革臨時(shí)用地概念進(jìn)行辨析,進(jìn)而介紹了產(chǎn)權(quán)經(jīng)濟(jì)學(xué)理論、可持續(xù)發(fā)展理論、節(jié)約集約利用理論以及生態(tài)文明理論對(duì)本文的啟示。結(jié)合目前采礦用地制度,指出在露天礦采礦用地取得與退出中存在的問題,帶著亟需解決的問題對(duì)露天礦采礦用地改革政策進(jìn)行分析,并在提高工作效率、增加經(jīng)濟(jì)收益、利于民生發(fā)展、改善生態(tài)環(huán)境四個(gè)方面對(duì)露天礦采礦用地改革進(jìn)行效益分析,從而提出露天礦采礦用地改革的迫切需要。其次是探尋露天礦采礦用地改革實(shí)現(xiàn)的影響因子,通過對(duì)“剝采-運(yùn)輸-排土-復(fù)墾”系統(tǒng)研究,在剝采階段、運(yùn)輸排土階段、土地復(fù)墾階段中對(duì)影響開采進(jìn)度、影響還地周期的環(huán)節(jié)的影響因子進(jìn)行剖析,對(duì)下一步政策推廣試點(diǎn)審批提供評(píng)價(jià)標(biāo)準(zhǔn)。通過列舉目前已經(jīng)審批通過的露天礦采礦用地改革試點(diǎn)礦區(qū)實(shí)施進(jìn)展情況,根據(jù)實(shí)地調(diào)研露天礦采礦用地改革試點(diǎn)中遇到的阻礙,總結(jié)露天礦采礦用地改革制度問題。根據(jù)“采剝-運(yùn)輸-排土-復(fù)墾”一體化過程,探討采礦用地方式改革進(jìn)展中存在的問題,篩選主要影響因子,對(duì)典型試點(diǎn)區(qū)域進(jìn)行適用性分析,為下一步確定采礦用地改革試點(diǎn)的適用范圍提供數(shù)據(jù)支撐。最后根據(jù)實(shí)際實(shí)施中出現(xiàn)的問題,提出政策建議,促進(jìn)露天礦采礦用地改革政策更完善更健全。
[Abstract]:The contradiction between the increasing demand for mineral resources and the insufficient allocation of mining land is becoming more and more serious. Establishing a reasonable system of mining land is the key to solve this problem. According to the actual demand to establish an effective and reasonable mode of supply of mining land, under the "mining-land" contradiction to promote the country to promote the pilot reform of mining land. Based on the research of the system and policy of mining land reform, this paper summarizes the problems under this mode and discusses the scope of application of the reform of mining land. In order to improve the reform of mining land system, it is of great significance for the development and utilization of mineral resources, the rational allocation of land resources and the sustainable use of mining land in China. The concept of temporary land for mining land reform is analyzed, and then the theory of property right economics and sustainable development are introduced. Combined with the current mining land system, the paper points out the problems existing in the acquisition and withdrawal of open-pit mining land. With the urgent need to solve the problems of open-pit mining land reform policy analysis, and in order to improve work efficiency, increase economic benefits, conducive to the development of people's livelihood. This paper analyzes the benefit of the reform of open pit mining land in four aspects of improving ecological environment, and puts forward the urgent need of the reform of open pit mining land. Secondly, it explores the factors affecting the realization of the reform of open pit mining land. Through the systematic study of "stripping, transportation, draining and reclamation", this paper analyzes the influencing factors in the stage of stripping, transportation and dumping, and the stage of land reclamation, which affect the progress of mining and the period of returning land. To provide evaluation criteria for the next policy extension pilot approval. By listing the current approved opencast mining land reform pilot mining area implementation progress. Based on the field investigation of the obstacles encountered in the pilot project of open-pit mining land reform, this paper summarizes the reform system of open-pit mining land. According to the integration process of "mining, stripping, transportation, draining and reclamation". The problems existing in the reform of mining land use mode are discussed, the main influencing factors are screened, and the applicability of typical pilot areas is analyzed. Finally, according to the problems in practice, some policy suggestions are put forward to promote the improvement and perfection of the reform policy of open-pit mining land.
