清代“發(fā)!弊镅芯

【摘要】:“發(fā)冢”行為,是由來已久的社會現(xiàn)象。“發(fā)!钡某霭l(fā)點,有的出自財產(chǎn)追求,有的出自復(fù)仇心理,還有其他復(fù)雜的因素!鞍l(fā)冢”是一組罪名,它有許多形式,包括與盜墓相關(guān)的活動,其中以盜墓最為代表性。在中國古代社會,人們有“靈魂不滅”的生死觀及對祖先的孝道觀,他們都希望自己的祖先能夠入土為安,對待死者像對待生者一樣。對死者的尊重,是對生者莫大的安慰,也能保佑后代生活繁榮興旺。“發(fā)!毙袨閲乐仄茐牧斯湃说膫鹘y(tǒng)觀念,因此歷代統(tǒng)治者都制定嚴酷的法律以打擊這種行為。本文結(jié)合清代“發(fā)!弊锏穆晌,對清代“發(fā)冢”罪的典型案例進行歸納,分析其反映出的中國古代禮法觀念。本文除了緒論和結(jié)語之外,共分為三章展開論述,其具體的內(nèi)容要點如下:文章的緒論部分主要介紹了選題的背景與意義、文獻綜述、研究的思路與方法及論文選題的研究特色與創(chuàng)新之處。第一章概述了清代以前的“發(fā)!弊,先敘述了古代社會重視墳?zāi)贡Wo的社會背景,主要表現(xiàn)在古人的生死觀、孝道觀及統(tǒng)治者的提倡等方面,接著以朝代為順序,縱向敘述了清代以前的“發(fā)!爆F(xiàn)象及“發(fā)冢”律文;第二章敘述了清代的“發(fā)!甭晌,依據(jù)“發(fā)!狈缸镱愋偷牟煌,將清代的“發(fā)!甭晌,歸納為四類,繼而敘述清末“發(fā)冢”律的改革與變化,其改革與變化的過程,反映了中國古代的“禮法之爭”;第三章是本文的重中之重,該章結(jié)合《大清律例》關(guān)于“發(fā)!钡姆l,將“發(fā)冢”罪的典型案例,歸類整理為五種不同的類型,進而分析清律對這些“發(fā)!弊锏乃痉ㄌ幹谩G宕鞍l(fā)!弊锏姆缸锴楣(jié)不同,清律對其相應(yīng)的司法處置也就有所不同,這充分地體現(xiàn)了罪刑相當(dāng)?shù)脑瓌t。清律對親屬之間“發(fā)!毙袨榈乃痉ㄌ幹靡赜诔H,這體現(xiàn)了清律對親情的維護。在親屬之間“發(fā)!弊镏,清律對卑幼的司法處置要重于尊長,這體現(xiàn)了古代尊卑之間不平等的關(guān)系。隨著清代社會生活的“發(fā)冢”案件不斷地增多,清律變得越來越嚴密,其對“發(fā)!弊锏乃痉ㄌ幹靡苍絹碓絿揽,古代禮法觀念對清律的影響也越來越深。文章的結(jié)語部分結(jié)合當(dāng)代依法治國的社會背景,倡導(dǎo)人們應(yīng)當(dāng)通過法律途徑維護死者最后的尊嚴。
[Abstract]:"Tomb" behavior, is a long-standing social phenomenon. The starting point of Maotsuka, some from the pursuit of property, some from revenge, and other complex factors. Mausoleum is a group of charges that take many forms, including activities related to grave theft, of which grave theft is the most representative. In ancient Chinese society, people had a view of life and death and filial piety to their ancestors. They all hoped that their ancestors would be able to live in peace and treat the dead as if they were living. Respect for the dead is a great comfort to the living and a blessing for future generations. The act of "mound" seriously undermined the traditional ideas of the ancients, so the rulers of all dynasties enacted harsh laws to crack down on this kind of behavior. In this paper, the author sums up the typical cases of the crime of "Maitsuka" in Qing Dynasty, and analyzes the concept of etiquette and law in ancient China, which is reflected in the typical cases of the crime of "Maitsuka" in Qing Dynasty. In addition to the introduction and conclusion, this paper is divided into three chapters, the main points of its content are as follows: the introduction of the article mainly introduces the background and significance of the topic, literature review, The ideas and methods of the research and the research features and innovations of the thesis. The first chapter summarizes the crime of "tombs" before Qing Dynasty, first describes the social background of ancient society attaching importance to the protection of graves, mainly in the aspects of ancient people's view of life and death, filial piety and the advocate of rulers, and then takes the dynasties as the sequence. It describes the phenomenon of "mound" before Qing Dynasty and the law of "Maitsuka". In the second chapter, according to the different types of crimes in the Qing Dynasty, the author classifies the law in the Qing Dynasty into four categories, and then narrates the reform and change of the law in the late Qing Dynasty, and the process of the reform and change of the law, and the process of the reform and change in the law of the Maitsuka in the end of the Qing Dynasty, according to the different types of crimes. Reflects the ancient Chinese "ceremony and law dispute"; The third chapter is the most important part of this paper. Combined with the law of the Qing Dynasty, this chapter classifies the typical cases of the crime of Maotsuka into five different types, and then analyzes the judicial disposition of these crimes by Qing Dynasty. In Qing Dynasty, the circumstances of the crime are different, and the corresponding judicial disposition is different in Qing Dynasty, which fully reflects the principle of the equivalent of crime and punishment. The judicial disposition of the law of Qing Dynasty to the behavior of "mound" between relatives should be more important than that of ordinary people, which reflects the maintenance of the kindred feelings of the law of Qing Dynasty. In the crime of "mound" between relatives, the judicial disposition of the Qing Dynasty to the humble children should be more important than that of the superior, which reflects the unequal relationship between the superior and inferior in ancient times. With the incessant increase of the cases of "mound" in the social life of Qing Dynasty, the Qing law has become more and more strict, and its judicial disposition to the crime of "mausoleum" has become more and more severe, and the ancient concept of etiquette and law has influenced the Qing law more and more deeply. Combined with the social background of ruling the country according to law, the conclusion of the article advocates that people should protect the final dignity of the dead through legal means.
