【摘要】：根據(jù)漢代不同時期刑徒兵役的特點,大體可劃分為西漢前期、武帝至新莽、東漢三個階段。西漢前期,"無為而治"思想使得征伐不多,加之以授田制為基礎的征兵制可保證充足的兵源,故此時征發(fā)刑徒服兵役尚屬偶然;自武帝至新莽,土地兼并導致了征兵制的破壞,此外,龐大的戰(zhàn)爭規(guī)模也需要廣辟兵源,故征發(fā)刑徒服兵役成為常態(tài);東漢時期,劉秀開創(chuàng)了"柔道政治",廣赦刑徒,加之為減少自耕農(nóng)破產(chǎn)而有意減少征兵的舉措,以及光武帝軍制改革的影響,征發(fā)刑徒服兵役在東漢漸成定制。和西漢比較,東漢征發(fā)刑徒服兵役的范圍一般面向全國,強制色彩更為突出,鼓勵刑徒兵家屬赴邊居住。
[Abstract]:According to the characteristics of criminal military service in different periods of Han Dynasty, it can be divided into three stages: early Western Han Dynasty, from Emperor Wu to New Mang, and from Eastern Han Dynasty. In the early Western Han Dynasty, the idea of "rule without action" made the conscription system based on conscription based on the conscription system guarantee sufficient sources of soldiers, so it was accidental to enlist and issue prisoners for military service. From Emperor Wu to New Mang, land annexation led to the destruction of the conscription system. In addition, the huge scale of the war also required a wide range of soldiers, so conscribing and issuing prisoners for military service became the norm. During the Eastern Han Dynasty, Liu Xiu pioneered the "Judo Politics" and amnesties the criminals, in addition to the deliberate reduction of conscription in order to reduce the bankruptcy of peasant farmers. As well as the influence of the reform of the military system of Emperor Guangwu, conscribing and issuing prisoners for military service gradually became custom in the Eastern Han Dynasty. Compared with the Western Han Dynasty, the scope of the Eastern Han Dynasty conscribing and issuing prisoners for military service is generally facing the whole country, and the compulsory color is more prominent, and the families of the prisoners are encouraged to live in the border.
