【摘要】：北魏酷吏作為一個特殊群體,其產(chǎn)生、發(fā)展均與北魏政治密切相關。與其他朝代酷吏相比,北魏酷吏群體表現(xiàn)出諸多“個性”。本文擬以此為切入點,探討北魏酷吏群體特點及其成因,從一個側面深化對北魏政治的認識和理解。 “酷吏”一詞始于西漢,后為歷代史家所沿用,但其涵義在漢唐之間頗有變化�；诖�,本文第一部分擬對“酷吏”涵義在漢唐之間的演變加以梳理。在此基礎上,對北魏酷吏的涵義進行界定,并對北魏酷吏群體成員的基本情況進行統(tǒng)計整理,以作為研究的基礎性資料。 北魏疆域遼闊,民族構成、民族關系復雜,其核心則為胡漢關系。據(jù)統(tǒng)計數(shù)據(jù)可知,北魏酷吏群體成員構成中民族差異較為明顯,本文第二部分著重考察北魏酷吏群體成員的民族構成及其在不同階段的變化情況,進而探討造成這些變化的原因。 作為北魏官吏隊伍中的一個特殊群體,北魏酷吏的政治行為有一定共性,但由于人生閱歷、家世背景、個人性格等方面存在差異,具體到每一個酷吏成員來說,他們所表現(xiàn)出來的行為又有較大差別�；谶@種差異的客觀存在,在對相關史料解讀的基礎上,根據(jù)為政動機、行為和表現(xiàn),將北魏酷吏劃分為“貪虐”型與“功用”型兩類,本文第三部分即主要探討這一問題。 官吏隊伍的狀況直接影響到政治的運作,而吏治之清明或腐敗,根本上取決于政治制度的約束。政治制度的完善及其有效實施,有利于實現(xiàn)吏治清明,反之則容易造成吏治敗壞,北魏酷吏之“貪穢狼藉”很大程度上在于制度的缺失。本文第四部分擬從班賞制度的興廢、俸祿制度具體實施情況等角度,探討北魏酷吏“貪賄狼藉”的成因。另外,考慮到鮮卑族乃崛起于漠北的胡族,其民族文化性格對北魏政治的發(fā)展有較大影響,在探討北魏酷吏“貪穢狼藉”成因時,也從鮮卑族之民族文化性格角度略加分析。 作為傳統(tǒng)政治文化中的一種常見現(xiàn)象,酷吏屢見史乘,因此,分析酷吏現(xiàn)象,就必須考慮中國傳統(tǒng)政治的特點及其指導思想等因素。研究表明,酷吏的產(chǎn)生與法家思想有著最直接的聯(lián)系,法家以法治國、重刑重殺等思想主張,實為歷代酷吏產(chǎn)生的思想根源。就北魏而言,情況又略有不同,主要表現(xiàn)為拓跋鮮卑尚武、尚功的民族文化性格,與法家嚴刑峻法思想的兩相重疊,二者的重疊導致北魏確立了嚴酷的政風,從而成為北魏酷吏產(chǎn)生的溫床。此外,隨著司法實踐中刑訊的廣泛采用,北魏推出了保障刑訊的立法,為北魏酷吏施政提供法律基礎的同時,更提供了制度保障。本文第五部分對此亦略加分析。 隨著漢化程度的加深,北魏酷吏所表現(xiàn)出的“貪虐”引起統(tǒng)治階層及社會民眾的不滿,本文結論部分在全面梳理前文研究思路和研究成果的基礎上,對北魏后期整肅吏治的努力及其失敗進行了分析,進而揭示北魏后期酷吏與皇權之間的“共生”依存關系�；蕶啾罎�,則無論循吏還是酷吏,都喪失了存在的依托,北魏酷吏隨著北魏政權的滅亡而走向盡頭。
[Abstract]:As a special group , Beiwei officials are closely related to the politics of the Northern Wei Dynasty . Compared with other dynasties , the Northern Wei officials have many " personalities . " This paper intends to probe into the characteristics and causes of Beiwei ' s officials , and deepen the understanding and understanding of the politics of the Northern Wei Dynasty from one side .

The first part of this article is to define the meaning of the " hot officials " in the Han and Tang dynasties . On the basis of this , this article defines the meaning of the officials in the Northern Wei Dynasty , and makes statistical analysis on the basic information of the members of the Northern Wei officials , so as to serve as the basic information of the study .

The second part of this paper focuses on the study of the ethnic composition of the members of the Northern Wei - officials group and their changes in different stages , and then probes into the causes of these changes .

As a special group in the ranks of Beiwei officials , the political behavior of the Northern Wei officials has a certain commonness , but because of the existence of life experience , family background , personal character and so on , there is a great difference between them . With the deepening of the degree of Han and the dissatisfaction of the ruling class and the society , the conclusion part of this paper analyzes the efforts and failures of the officials in the later stage of the Northern Wei Wei Dynasty , and then reveals the " symbiotic " dependency between the officials and the imperial power in the later stage of the Northern Wei Wei Dynasty .
