【摘要】："文學法理,咸精其能"并非兩宋士大夫法律素養(yǎng)的普遍狀態(tài)。從兩宋時期"吏強官弱"的司法生態(tài)以及"阿云之獄"中士大夫們的整體表現(xiàn),可以看出兩宋士大夫群體的法律素養(yǎng)并不是很高。對于中國古代法律文化而言,只有建立在客觀事實基礎(chǔ)上的判斷,才有益于該問題的進一步探究。
[Abstract]:"Literary legalism" is not the universal state of the legal literacy of the literati in the two Song dynasties. From the judicial ecology of "officials strengthening officials and weak" in the Song Dynasty and the overall performance of the literati and officials in "A Yun Jail", It can be seen that the legal literacy of the literati and bureaucrats in the Song Dynasty is not very high. For the ancient Chinese legal culture, only the judgment based on the objective facts can benefit the further exploration of the problem.
