【摘要】：本文主要由以下六個(gè)部分組成: 第一部分為緒論。主要交代本文的選題意義、研究目的及研究現(xiàn)狀等。在研究現(xiàn)狀部分,對(duì)學(xué)界相關(guān)的著作、論文逐一作了簡(jiǎn)介。 第二部分為第一章,主要介紹宋真宗在位時(shí)期的立法狀況。提出編敕是這一時(shí)期最主要的立法形式,并對(duì)前人的研究成果作了一番梳理。同時(shí)指出,當(dāng)時(shí)已經(jīng)有了專門(mén)的立法機(jī)構(gòu)——編敕所,由該機(jī)構(gòu)負(fù)責(zé)立法事務(wù),向皇帝提出立法建議以及協(xié)調(diào)不同位階的法律之間的沖突。 第三部分為第二章,主要介紹了宋真宗時(shí)期的刑事法律。真宗在位期間,對(duì)新出現(xiàn)的、《刑統(tǒng)》沒(méi)有加以規(guī)制的一些犯罪以詔令的形式予以定罪量刑,不僅填補(bǔ)了成文法典的疏漏,而且也完善了宋代的刑事法律規(guī)范。 第四部分為第三章,主要介紹了宋真宗時(shí)期的刑罰制度。刑罰的輕重,是對(duì)當(dāng)時(shí)的法制狀況、社會(huì)形態(tài)以及統(tǒng)治者的刑罰理念的反映。大體而言,真宗一朝,刑罰適用的趨勢(shì)仍是寬仁平允,鮮有法外行刑、濫用刑罰之事。改元大中祥符之后,刑罰的執(zhí)行便與封祀活動(dòng)緊密相關(guān),在大量寬宥罪犯的同時(shí),也在一定程度上造成了對(duì)成文法制的破壞。 第五部分為第四章,主要介紹了宋真宗時(shí)期的司法制度。選取了司法機(jī)構(gòu)、司法官吏、訴訟制度和監(jiān)獄制度四個(gè)斷面,反映該時(shí)期的司法狀況。其中,訴訟制度詳述了真宗時(shí)期有關(guān)起訴及其他特別訴訟制度的規(guī)定,監(jiān)獄制度部分詳述了真宗時(shí)期的淹系、慮囚和獄空情況。 最后為本文的結(jié)語(yǔ),通過(guò)對(duì)史料的考察和分析,對(duì)真宗在位25年間的法制狀況給出一個(gè)整體性的評(píng)價(jià)。
[Abstract]:This paper consists of the following six parts: The first part is the introduction. It mainly explains the significance of the topic, the purpose of the research and the present situation of the research. In the part of the present research, the paper introduces the related works of academic circles one by one. The second part is the first chapter, mainly introduces the legislative situation during the reign of Song Zhenzong. It puts forward that editing is the most important form of legislation in this period, and combs the previous research results. At the same time, it points out. At that time, there was a special legislative body, which was responsible for legislative affairs, advising the emperor on legislation, and reconciling conflicts between different levels of law. The third part is the second chapter, which mainly introduces the criminal law of Song Zhenzong period. During the reign of Zhenzong, some new crimes, not regulated by "Criminal system", were convicted and sentenced in the form of Dahir. It not only filled in the omission of the written code, but also perfected the criminal law norms of the Song Dynasty. The 4th part is the third chapter, which mainly introduces the penalty system of the Song Dynasty. The severity of the penalty is the reflection of the legal system, the social formation and the penalty idea of the rulers at that time. The trend of penalty application is still wide benevolence, rarely outside the law execution, abuse of penalty. After the reform of the symbol, the execution of the penalty is closely related to the activities of the seal worship, while a large number of lenient criminals at the same time. To some extent, it also caused the destruction of the statutory system. The 5th part is 4th chapter, which mainly introduces the judicial system of Song Zhenzong period. It selects four sections of judicial institutions, judicial officials, litigation system and prison system to reflect the judicial situation of that period. The litigation system details the provisions of the prosecution and other special litigation systems during the True Zong period, while the prison system describes in detail the inundation, concern and emptiness of the prison system during the True Zong period. Finally, the conclusion of this paper, through the investigation and analysis of historical data, gives a holistic evaluation of the legal system during the 25 years of the reign of Zhenzong.
