清末甘南藏區(qū)部落糾紛解決形態(tài)研究——以光緒十六年卡家與沙溝的爭佃沖突為中心

【摘要】：光緒十六年(1890)卡家與沙溝爭佃沖突的解決形態(tài),既非嚴(yán)格意義上的調(diào)解,也非嚴(yán)格意義上的官府審判,其實質(zhì)可視為具有"首唱—唱和"結(jié)構(gòu)的"約"的規(guī)范秩序的形成。其中,官府成為最終的首唱者,沙溝及其支持者隆務(wù)寺一方與卡家及其支持者拉卜楞寺一方是唱和者,眾鄉(xiāng)老是中介人。在沖突的解決過程中,各方為如何使他方承認己方所主張的解決方案而進行反復(fù)的首唱與唱和,其中或爭斗或調(diào)解或彈壓的活動,實際上都可視為力圖獲取首唱這一身份地位而進行對抗與整合的過程。這種通過"約"的方式而形成的社會秩序很不穩(wěn)定,呈現(xiàn)很大的流動性。
[Abstract]:The form of resolving the conflict between Ka Jia and Shagou in Guang Xu 16 years (1890) is neither the mediation in the strict sense nor the judgment of the government in the strict sense. Its essence can be regarded as the formation of the normative order with the structure of "first singing-singing and singing". Among them, the government became the final first singer, Shagou and its supporters Longwu Temple side and the Cabrum and its supporters Labran Temple side is the singer, the township is always intermediary. In the course of the settlement of the conflict, the parties engage in repeated singing and praising of how to make the other party recognize the solution advocated by the other party, in which there is either a fight or mediation or a repressive activity, In fact, it can be seen as a process of confrontation and integration in an effort to gain the status of the singer. The social order formed by the covenant is very unstable and presents great fluidity.
