【摘要】：晚清民國時期川西北民族地區(qū)存在地方官府管理、地方官府與土司土官雙重管理、土司土官管理、部落自治等多種政權(quán)管理類型。受復(fù)雜的政權(quán)管理、地理環(huán)境和族群因素等影響,該區(qū)域國家法律、土律土規(guī)、習(xí)慣法、鄉(xiāng)規(guī)民約和僧規(guī)戒律等多種法規(guī)并行。處理案件和糾紛時,地方官府按國家法律法規(guī)處置,土司土官主要按土律土規(guī)和習(xí)慣法處置、重大案件移送官府處置,自治部落按習(xí)慣法處置,鄉(xiāng)規(guī)民約、僧規(guī)戒律分別對民眾和僧尼具有較大行為約束作用。習(xí)慣法、鄉(xiāng)規(guī)民約、僧規(guī)戒律在社會治理中作用巨大,至今在當?shù)厣鐣钪腥杂兄匾幕绊�。推進民族地區(qū)當代法治建設(shè),應(yīng)注重發(fā)揮習(xí)慣法、鄉(xiāng)規(guī)民約、僧規(guī)戒律在法治體系建設(shè)中的補充作用。
[Abstract]:In the period of the late Qing Dynasty and the Republic of China, there were many types of power management in northwest Sichuan ethnic areas, such as local government management, local government administration and Tusi local government management, toast management, tribal autonomy, and so on. Influenced by complex regime management, geographical environment and ethnic group factors, there are many laws and regulations in the region, such as national law, soil law, customary law, local rule and monk discipline. In dealing with cases and disputes, the local authorities shall deal with them in accordance with the laws and regulations of the state, and the Tusi officials will mainly deal with them in accordance with the rules of the land and the customary law, the major cases shall be referred to the authorities for disposal, the autonomous tribes shall be dealt with in accordance with customary law, and the villagers' regulations shall be arranged. Sangha precepts have great behavior restraint to the people and monks and nuns respectively. Customary law, local rules and regulations play a great role in social governance, and still have important cultural influence in local social life up to now. In order to promote the construction of the contemporary rule of law in ethnic minority areas, we should pay attention to the supplementary role of customary law, rural regulations and monk precepts in the construction of the rule of law system.
