【摘要】：《中日修好條規(guī)》歷來被視為近代中日兩國(guó)的唯一對(duì)等條約�？伤煤笄宄獙賴�(guó)的次第喪失事件和臺(tái)灣日據(jù)事件每每被處理成彼此無涉的孤立個(gè)案等研究現(xiàn)狀表明,中國(guó)學(xué)界對(duì)于條規(guī)本身的對(duì)等屬性問題尚缺少體系性的反思。事實(shí)上,肇端于牡丹社事件的日本征臺(tái)、巧取琉球、并吞朝鮮以及甲午戰(zhàn)后的割占臺(tái)灣等事件,無一不根源于條規(guī)這一法理前提。日本拆解宗藩體系的整體設(shè)計(jì)與虛實(shí)進(jìn)路意味著,條規(guī)的簽署,不但讓中方喪失了東亞的傳統(tǒng)核心地位,還使清廷在日方的公法惡用下無法不棄琉保臺(tái)、棄韓自保直至割臺(tái)茍安。近代以降東亞世界的整體變局和日本對(duì)鄰國(guó)的侵越與壓迫,亦始自條規(guī),成于條規(guī)。
[Abstract]:The Sino-Japanese Friendship Regulation has always been regarded as the only reciprocal treaty between China and Japan in modern times. The subsequent secondary loss of the subordinate states of the Qing Dynasty and the Japanese occupation events in Taiwan are often dealt with as isolated cases which have nothing to do with each other, indicating that there is still a lack of systematic reflection on the reciprocal nature of the rules in Chinese academic circles. In fact, the Japanese invasion of Taiwan, which originated in the Peony Society incident, the skillful acquisition of Ryukyu, the annexation of Korea and the occupation of Taiwan after the Sino-Japanese War of 1894, all originated from the legal premise of rules and regulations. The overall design of Japan's dismantling of the Suzerain-vassal system and its approach to the virtual reality meant that the signing of the rules and regulations not only deprived the Chinese side of their traditional core status in East Asia, but also made it impossible for the Qing Dynasty to abandon the protection of Taiwan under the evil use of Japanese public law. Abandon Han Zipao until the cutting stage is meticulous. In modern times, the whole change of the East Asian world and Japan's invasion and oppression of neighboring countries began from rules and regulations.
