【摘要】：清末以降,廣州行會(huì)勞資糾紛多以勞方"聯(lián)行停工"的方式出現(xiàn),且以加薪、違反行規(guī)引發(fā)居多。至其調(diào)解方式主要有兩種:一是勞資直接協(xié)商解決,即以傳統(tǒng)行會(huì)的行規(guī)約束機(jī)制來維系,實(shí)質(zhì)是"勞資合行"理念作用的結(jié)果;二是官府強(qiáng)制裁決。在這兩種方式中,盡管"勞資合行"的協(xié)商合作理念仍居主導(dǎo),但已呈現(xiàn)出由行會(huì)調(diào)解向官府裁決轉(zhuǎn)移的趨勢(shì),這似可說明傳統(tǒng)行會(huì)消除內(nèi)部分歧、維系團(tuán)結(jié)的機(jī)能與威信已趨式微,同時(shí)也意味著"勞資合行"理念亦瀕臨崩潰,并逐漸為"勞資分離"的階級(jí)意識(shí)所取代。
[Abstract]:At the end of Qing Dynasty, labor disputes in Guangzhou guild appeared in the form of "union bank shutdown" and wage increase, which caused most of them to violate industry regulations. There are two main ways of mediation: one is the direct negotiation between labor and capital, that is to say, the traditional guild's binding mechanism is to maintain it, which is the result of the idea of "collective bank", and the other is the compulsory ruling by the government. In these two ways, although the idea of consultation and cooperation of the "collective bank" is still dominant, it has shown a trend of shifting from guild mediation to government adjudication, which seems to indicate that the traditional guilds have overcome their internal differences. The function and prestige of maintaining unity has declined, which also means that the concept of "labor union" is on the verge of collapse and is gradually replaced by the class consciousness of "separation of labor and management".
