【摘要】： 摘要：犯罪是一種極為復(fù)雜的社會現(xiàn)象,某一特定歷史時(shí)期犯罪的情況、特點(diǎn)和變化規(guī)律,都是該時(shí)期特定條件下社會政治、經(jīng)濟(jì)、教育和家庭等因素的綜合反映。北洋軍閥時(shí)期,中國社會軍閥割據(jù),資本主義經(jīng)濟(jì)初步發(fā)展,思想文化特別是法制思想受西方影響較大。20世紀(jì)20年代,青島剛剛結(jié)束外國殖民統(tǒng)治,開始了北洋政府統(tǒng)治時(shí)期,經(jīng)濟(jì)上由封建經(jīng)濟(jì)逐步向資本主義經(jīng)濟(jì)轉(zhuǎn)型,社會思想文化受外國文化沖擊,新舊激烈文化碰撞,作為社會的一面特殊鏡子—犯罪,也具有著鮮明的時(shí)代特征。1923-1927年,青島社會犯罪主要分為財(cái)產(chǎn)犯罪、暴力犯罪、風(fēng)俗犯罪、破壞犯罪、經(jīng)濟(jì)犯罪、毒品犯罪和涉外犯罪七種類型,作為犯罪率最高的財(cái)產(chǎn)類犯罪,其根本原因就是該時(shí)期政治的動(dòng)蕩和轉(zhuǎn)型期封建經(jīng)濟(jì)的解體和資本主義經(jīng)濟(jì)發(fā)展的不充分,導(dǎo)致的下層社會貧困問題嚴(yán)重。其余暴力犯罪的泛濫和風(fēng)俗犯罪、破壞犯罪和經(jīng)濟(jì)犯罪的新特征、毒品犯罪和涉外犯罪的特殊歷史背景以及變化趨勢都直接或間接反映出當(dāng)時(shí)青島社會的政治、經(jīng)濟(jì)社會面貌。通過政府行政機(jī)構(gòu)法院、監(jiān)獄對犯罪案件的審理和罪犯的懲治和教養(yǎng),反映出近代西方資本主義法制精神對于中國法制建設(shè)的影響。
[Abstract]:Absrtact: crime is a very complicated social phenomenon. The circumstances, characteristics and changing rules of crime in a certain historical period are the comprehensive reflection of social politics, economy, education and family under the specific conditions of that period. During the period of the Northern warlords, the Chinese society was divided by warlords, the capitalist economy was initially developed, and the ideology, culture, especially the legal system were greatly influenced by the West. In the 1920s, Qingdao just ended its foreign colonial rule and began the period of the Beiyang government. From feudal economy to capitalist economy, social ideology and culture were impacted by foreign culture, new and old fierce culture collided, as a special mirror of society, crime also had distinct characteristics of the times from 1923 to 1927. Social crimes in Qingdao are divided into seven types: property crime, violent crime, custom crime, sabotage crime, economic crime, drug crime and foreign-related crime. The fundamental reason is the political turbulence in this period, the disintegration of feudal economy in the transition period and the insufficiency of capitalist economic development, which leads to the serious poverty problem in the lower society. The spread of other violent crimes and custom crimes, the new characteristics of crime and economic crime, the special historical background and changing trend of drug crime and foreign crime all directly or indirectly reflect the political, economic and social outlook of Qingdao society at that time. Through the courts of government administration, the trial of criminal cases in prison and the punishment and upbringing of criminals, it reflects the influence of the spirit of modern western capitalist legal system on the construction of Chinese legal system.
