【摘要】：正中國古代法律以儒家傳統(tǒng)思想為建構(gòu)基礎(chǔ),把刑法作為法律建構(gòu)的重點,其他法律是作為輔助作用存在的。這種封建的法律體系在中國沿用了很長的時間,對中國近代法律的形成也有一定的影響。但是,中國近代法律的形成很大程度上具有一定的悲劇性,它是堅船利炮下的產(chǎn)物,可以說是在不得已的情況下產(chǎn)生的,它并沒有延續(xù)中國古代法律的發(fā)展軌跡。由于19世紀鴉片戰(zhàn)爭的爆發(fā),中國與世界產(chǎn)生了不曾有過的聯(lián)系,這種聯(lián)系完全改變了中國近代法律的發(fā)展方
[Abstract]:The ancient Chinese law was constructed on the basis of the Confucian tradition, and the criminal law was regarded as the focal point of the legal construction, and other laws existed as auxiliary functions. This feudal legal system has been in use in China for a long time. However, the formation of modern Chinese law to a large extent has a certain tragedy. It is the product of a strong boat and a sharp gun, and can be said to have come into being under the circumstances of necessity. Because of the outbreak of the Opium War in 19th century, the relationship between China and the world had never been established, which completely changed the development side of Chinese modern law.
