【摘要】： 本文以唐代婚姻法律制度與婚俗現(xiàn)實的矛盾關系為中心,采用實證分析和歷史分析的研究方法,試圖解開唐代社會婚姻法律制度與婚俗現(xiàn)實之間存在巨大差距的原因。作者通過史實、傳記、傳奇、小說中的各種事例,一一對照婚俗與法律規(guī)定不符,甚至截然相反的狀況。包括:法定六禮儀式與現(xiàn)實簡化儀式之間的矛盾,合法婚姻與非法婚姻的對比,限制離婚、再嫁、鼓勵守志與離婚自由、再嫁自由、忽視貞潔觀念的對比。作者從經(jīng)濟、政治、文化多角度分析這些矛盾現(xiàn)象背后的深層次的原因。在得出結(jié)論的同時,在唐代婚姻法律實踐中探尋有價值的婚姻立法、司法實踐經(jīng)驗,形成對現(xiàn)代社會婚姻法律實踐有積極意義的借鑒與啟發(fā)。
[Abstract]:Based on the contradictory relationship between marriage law system and marriage custom reality in Tang Dynasty, this paper tries to solve the great gap between marriage law system and marriage custom reality in Tang Dynasty by means of empirical analysis and historical analysis. Through historical facts, biographies, legends and stories, the author contrasts the marriage custom with the law and even the opposite. It includes: the contradiction between statutory six ceremonial and realistic simplified rituals, the comparison between legal marriage and illegal marriage, the restriction of divorce and remarriage, the encouragement of keeping one's will and the freedom of divorce, the freedom to remarry, and the neglect of the contrast of the concept of virginity. The author analyzes the underlying causes of these contradictions from the angles of economy, politics and culture. At the same time, in the Tang Dynasty marriage law practice to explore the valuable marriage legislation, judicial practice experience, the formation of modern society marriage law practice has a positive significance and inspiration.
