【摘要】：本文以漢代宗室王侯的犯罪問題為主要研究對象,兼論漢代政府對宗室王侯的思想控制。因此,本文共分為四章。第一章主要對漢代宗室王侯的犯罪進行歸納分類,按照罪行的不同性質(zhì),劃分為政治犯罪、倫理犯罪、刑事犯罪三大類,這三類罪行幾乎囊括了所有漢代宗室王侯的違法行為。在這三大種類劃分的基礎(chǔ)之上,我們再進行細分,對每一項罪行的基本概念進行闡述,并試圖對其危害進行評估。第二章則是對漢代宗室王侯的訴訟程序進行了分析整理,但我們并不是對漢代的基本訴訟程序進行總結(jié),而是突出宗室王侯犯罪案件的特點：如在訴訟提起這一環(huán)節(jié)中所體現(xiàn)的針對宗室成員的有效監(jiān)督、在逮捕以及審訊環(huán)節(jié)中看到的宗室王侯享有的法律特權(quán),以及在議罪定刑及刑罰執(zhí)行中體現(xiàn)出的對宗室王侯、尤其是諸侯王的優(yōu)容。此外,在訴訟過程中,皇帝牢牢把持著對宗室王侯的裁決權(quán),這無疑是皇權(quán)凌駕于司法權(quán)力之上的表現(xiàn)。在第三章中,我們將通過更多的圖表和數(shù)字,來分析漢代宗室王侯犯罪的時代特征,并且找其背后所隱藏的政治因素。此外,第三章還會討論漢代宗室王侯中出現(xiàn)的亂倫行為,作為漢代宗室王侯犯罪中一個引人關(guān)注的現(xiàn)象,我們將嘗試著對其產(chǎn)生及消失的原因進行分析。最后,本章中還將前代諸侯、王族、公族的犯罪情況與作為比較對象,以闡述在統(tǒng)一帝國建立之后,漢代宗室王侯犯罪所表現(xiàn)出的新特征。第四章則是總結(jié)了漢代政府對宗室王侯的思想控制方法,這其中包括了教育、官吏監(jiān)督、獎勵、策戒、賜謚五種方式,它們對于預(yù)防宗室王侯的犯罪,乃至對其進行控制和規(guī)訓(xùn),都起到了舉足輕重的作用。
[Abstract]:This paper focuses on the crime of royal princes in Han Dynasty, and on the ideological control of imperial princes in Han Dynasty. Therefore, this paper is divided into four chapters. The first chapter summarizes and classifies the crimes of royal princes in Han Dynasty. According to the different nature of the crimes, they are divided into three categories: political crime, ethical crime and criminal crime. These three kinds of crimes include almost all the illegal acts of royal princes in Han Dynasty. On the basis of the classification of these three categories, we subdivide the basic concepts of each crime and try to evaluate its harm. The second chapter is to analyze the proceedings of the royal princes in the Han Dynasty, but we do not summarize the basic proceedings of the Han Dynasty. Instead, it highlights the characteristics of the criminal cases of the royal princes: such as the effective supervision of the members of the clan embodied in the initiation of the proceedings, the legal privileges enjoyed by the monarchs during the arrest and interrogation, And the superior tolerance of the royal princes, especially the kings. In addition, in the process of litigation, the emperor firmly held on to the ruling power of royal princes, which undoubtedly showed that the imperial power was superior to the judicial power. In the third chapter, we will analyze the characteristics of the times of the crimes committed by the imperial princes in the Han Dynasty through more charts and figures, and find the political factors hidden behind them. In addition, the third chapter will also discuss the incest behavior in the Han Dynasty royal princes. As a phenomenon that attracts attention in the Han Dynasty, we will try to analyze the causes of its emergence and disappearance. Finally, this chapter also compares the crimes of the previous dynasties' princes, princes and dukes as the objects of comparison, in order to expound the new characteristics of the crimes committed by the monarchies of the Han Dynasty after the establishment of the unified empire. The fourth chapter summarizes the Han Dynasty government's methods of ideological control over monarchs and princes, including education, supervision by officials, rewards, precepts, and posthumous titles, which contribute to the prevention of crimes committed by monarchs and princes. Even to its control and discipline, have played a pivotal role.
