【摘要】：禁約合同是同族、同村人等為禁止盜竊、砍伐樹(shù)木、保護(hù)來(lái)龍與水口等事務(wù),共同立約承諾并議定罰則的合同文書(shū)。其適用領(lǐng)域廣泛,類型多樣,訂立主體多為宗族、會(huì)社以及數(shù)姓的聯(lián)合;內(nèi)容上更多地體現(xiàn)為禁止、懲罰等強(qiáng)制性規(guī)范。對(duì)違禁行為進(jìn)行私力救濟(jì)或"呈官究治",保證了禁約合同效力的實(shí)施。作為國(guó)家法的必要補(bǔ)充和延伸,禁約合同在基層社會(huì)秩序的構(gòu)建中扮演了十分重要的角色。
[Abstract]:The proscription contract is a contract document of the same family, the same village people, etc., to prohibit theft, cut down trees, protect the dragon and Shuikou, etc., and make the promise and agree on the punishment together. Its application field is extensive, the type is diverse, the main body is the clan, the club and the several surnames union; the content is more embodied in the prohibition, punishment and other mandatory norms. Private relief or "official investigation" for the prohibited acts ensures the enforcement of the validity of the proscription contract. As a necessary supplement and extension of national law, proscription contract plays a very important role in the construction of grass-roots social order.
