清代治理邪教犯罪研究(1644-1840年)

【摘要】: 在中國(guó)古代,清代邪教犯罪尤為盛行,故清政府強(qiáng)化了邪教犯罪的治理,積累了豐富的經(jīng)驗(yàn),其法律和措施具有典型意義,對(duì)中國(guó)現(xiàn)代構(gòu)建和完善治理邪教犯罪的法律制度也具有重要的借鑒作用。 全文分為五章。第一章,清代邪教盛行的原因。本章主要從政治、經(jīng)濟(jì)、文化、宗教、社會(huì)結(jié)構(gòu)等方面入手,對(duì)清代邪教蔓延并屢禁不止的外在根源作了一個(gè)簡(jiǎn)要的探討。 第二章,清代邪教犯罪主要表現(xiàn)形式。本章主要考察了清代邪教組織在政治、侵犯人身權(quán)利、侵犯財(cái)產(chǎn)、妨害社會(huì)管理秩序等方面的犯罪行為,揭示出清代邪教組織給國(guó)家和社會(huì)穩(wěn)定以及民眾生活帶來(lái)的嚴(yán)重危害性,以及清政府制定和采取治理邪教的法律、措施的合理性。 第三章,清代懲治邪教犯罪的法律制度。本章主要對(duì)清代懲治邪教犯罪法律規(guī)范的內(nèi)容進(jìn)行了系統(tǒng)的整理,并對(duì)其歷史演變、變化的原因和背景進(jìn)行探討和分析。在此基礎(chǔ)上,概括出清代懲治邪教犯罪刑罰適用的原則,并進(jìn)而揭示出清代懲治邪教犯罪法律規(guī)范的利弊得失。 第四章,清代治理邪教犯罪的行政措施。本章主要考察了清政府從經(jīng)濟(jì)、吏治、宗教、教化、基層政權(quán)控制等方面采取的各項(xiàng)措施和做法。 第五章,清代治理邪教犯罪的實(shí)踐。本章主要考察了清代皇帝、官僚和民眾這三種勢(shì)力在治理邪教實(shí)踐中表現(xiàn)出的不同態(tài)度和采取的不同行為,并對(duì)這種差異性加以剖析,進(jìn)而在法律措施方面揭示清代官府在治理邪教上的不足之處,以及對(duì)清代治理邪教實(shí)踐工作造成的影響。
[Abstract]:In ancient China, cult crimes were particularly prevalent in the Qing Dynasty, so the Qing government strengthened the governance of cult crimes, accumulated rich experience, and its laws and measures were of typical significance. It also plays an important role in constructing and perfecting the legal system of controlling cult crime in modern China. The full text is divided into five chapters. The first chapter is the reason why cults prevailed in Qing Dynasty. This chapter mainly from the political, economic, cultural, religious, social structure and other aspects, the spread of cults in the Qing Dynasty and repeated prohibition of external causes made a brief discussion. The second chapter, the main manifestations of cult crime in Qing Dynasty. This chapter mainly examines the criminal acts of cult organizations in the Qing Dynasty in such aspects as politics, violation of personal rights, infringement of property, obstruction of social management and order, etc. It reveals the serious harmfulness that the cult organization of the Qing Dynasty brought to the country and the social stability and the people's life, and the rationality of the Qing government's making and adopting the laws and measures to govern the cults. Chapter three, the legal system of punishing the crime of cults in Qing Dynasty. In this chapter, the contents of the legal norms for punishing cults in Qing Dynasty are systematically arranged, and the historical evolution, reasons and background of the changes are discussed and analyzed. On this basis, the principles of punishment applicable to cults in the Qing Dynasty are summarized, and the advantages and disadvantages of the legal norms for punishing cults in the Qing Dynasty are revealed. Chapter four, the administrative measures to control cult crime in Qing Dynasty. This chapter mainly examines the measures and practices adopted by the Qing government in economy, officials, religion, education, and the control of grassroots power. Chapter five, the practice of controlling evil cult crime in Qing Dynasty. This chapter mainly examines the Qing Dynasty emperor, bureaucrats and the people of these three forces in the practice of governance cult displayed different attitudes and different behavior, and to analyze this difference. Furthermore, in terms of legal measures, it reveals the shortcomings of the government in controlling cults in the Qing Dynasty and its influence on the practice of controlling cults in the Qing Dynasty.
