【摘要】： 本文選擇宋代的產(chǎn)權(quán)結(jié)構(gòu)、財產(chǎn)檢校制度與產(chǎn)權(quán)文書三個專題作為論述對象,運(yùn)用產(chǎn)權(quán)理論,分析說明產(chǎn)權(quán)制度對于激勵宋代社會經(jīng)濟(jì)的發(fā)展,維護(hù)社會相對穩(wěn)定的作用與影響。 緒論,界定了有關(guān)產(chǎn)權(quán)理論與概念,進(jìn)行學(xué)術(shù)史回顧,介紹本文的研究方法、資料來源與創(chuàng)新預(yù)期; 第一章主要說明產(chǎn)權(quán)的經(jīng)濟(jì)屬性,通過分析宋代產(chǎn)權(quán)結(jié)構(gòu)的基本內(nèi)容以及國家法律的相應(yīng)規(guī)定,指出產(chǎn)權(quán)結(jié)構(gòu)的不同主體會產(chǎn)生不同的產(chǎn)權(quán)權(quán)利束組合,從而影響經(jīng)濟(jì)的運(yùn)行方式; 第二章通過對宋代產(chǎn)權(quán)類型中共有產(chǎn)權(quán)的資產(chǎn)——宗族義田義莊、助學(xué)砥官義莊與舉子義莊、義役田莊的個案分析,論述共有產(chǎn)權(quán)的來源及其產(chǎn)權(quán)權(quán)利束的狀況,說明產(chǎn)權(quán)的社會屬性在宋代社會福利等方面的激勵作用; 第三章論述宋代戶絕法令與孤幼財產(chǎn)檢校法令的源流及其在宋代的演變、實(shí)施與影響,通過闡述宋代財產(chǎn)檢校制度,說明宋代國家在產(chǎn)權(quán)權(quán)利束中的界定與保護(hù)作用; 第四章闡述宋代民間主要產(chǎn)權(quán)文書——戶帖、砧基簿與分家關(guān)書的源流、內(nèi)容及其應(yīng)用,說明產(chǎn)權(quán)文書作為國家與資產(chǎn)、產(chǎn)權(quán)主體及其權(quán)利束的媒介的作用; 結(jié)論認(rèn)為,產(chǎn)權(quán)制度是宋代的基本經(jīng)濟(jì)制度之一,具有經(jīng)濟(jì)屬性與社會屬性,兩者相互作用,共同推動社會經(jīng)濟(jì)的發(fā)展與社會福利的提高。宋代的產(chǎn)權(quán)結(jié)構(gòu)主要可以分為私有產(chǎn)權(quán)、國有產(chǎn)權(quán)、共有產(chǎn)權(quán),其中私有產(chǎn)權(quán)占主導(dǎo)地位。宋代國家通過行使產(chǎn)權(quán)權(quán)力進(jìn)行財產(chǎn)檢校,來維護(hù)產(chǎn)權(quán)秩序與經(jīng)濟(jì)秩序,從而加強(qiáng)對鄉(xiāng)族勢力與地方社會的控制。宋代產(chǎn)權(quán)制度也不可避免地存在一些缺陷。
[Abstract]:This paper chooses the property right structure, the property inspection system and the property right document as the object of discussion, analyzes and explains the property right system to stimulate the social economy development of the Song Dynasty by using the property right theory. The role and influence of maintaining the relative stability of society. Introduction, defining the theory and concept of property rights, reviewing the academic history, introducing the research methods, data sources and innovation expectations; The first chapter mainly explains the economic attribute of property right. By analyzing the basic content of property right structure in Song Dynasty and the corresponding provisions of national law, it points out that different subjects of property right structure will produce different combination of property right bundle. Thus affecting the operation of the economy; The second chapter discusses the origin of the common property right and the condition of the property right bundle through the case analysis of the assets of the property right type of the Song Dynasty-Yi Tian Yi Zhuang of the patriarchal clan, Yi Zi Yi Zhuang and Yi Zi Yi Zhuang and Yi Jun Tian Zhuang of the aid of the students, and the paper discusses the origin of the common property right and the condition of the right bundle of the common property right. Explains the social attribute of the property right in the Song Dynasty social welfare and other aspects of the incentive role; The third chapter discusses the origin, implementation and influence of the laws of the Song Dynasty and the law of checking the children's property. By expounding the system of the property inspection in the Song Dynasty, the author explains the definition and protection role of the state in the bundle of property rights in the Song Dynasty. The 4th chapter expounds the origin, content and application of the main civil property rights documents in Song Dynasty, such as household post, anvil book and separated book, and explains the function of the property rights document as the medium of the state and assets, the subject of property right and its bundle of rights. The conclusion is that the property right system is one of the basic economic systems in the Song Dynasty. The structure of property rights in Song Dynasty can be divided into private property right, state-owned property right and common property right. In the Song Dynasty, the state maintained the order of property rights and economic order by exercising the power of property rights to carry out property inspections. In order to strengthen the control of rural forces and local society, the property right system of Song Dynasty also inevitably has some defects.
