【摘要】：《唐律疏議》是我國現(xiàn)存最早的一部封建成文法典，在古代中國具有重要的歷史地位，是以有不少當(dāng)代學(xué)者從各方面對該書進行了研究，在總結(jié)前人的基礎(chǔ)上，本文擬從現(xiàn)代法律體系角度探討《唐律疏議》的特點并對其特點產(chǎn)生的原因進行初步分析。 全文共分為兩個大的部分： 第一部分探求《唐律疏議》的特點。該部分又分六個小的部分，分別是律條與解釋的結(jié)合、以刑為主，諸法合體、不嚴格的以事實為依據(jù)和嚴格的以法律為準繩相結(jié)合、不平等法大量存在、責(zé)任制度、刑罰種類與涉外適用原則及其它。 第二部分從三個方面分析《唐律疏議》的這些特點產(chǎn)生的原因：法律的前后繼承、政治經(jīng)濟背景、時代局限性。 最后，概述《唐律疏議》的特點及其產(chǎn)生原因，，并簡要說明其研究意義。
[Abstract]:Tang Law is the earliest existing feudal written code in China, which has an important historical position in ancient China. Many contemporary scholars have studied the book from various aspects, on the basis of summing up the predecessors. This paper discusses the characteristics of Tang Law from the angle of modern legal system and analyzes the causes of its characteristics. The full text is divided into two parts: The first part explores the characteristics of the Tang Law, which is divided into six small parts, respectively, the combination of law and interpretation, mainly the punishment, the combination of various laws. Not strictly based on facts and strictly based on the law as the yardstick, inequality law exists in a large number, liability system, the types of penalties and foreign applicable principles and other. The second part analyzes the causes of these characteristics from three aspects: the inheritance of the law, the political and economic background, and the limitations of the times. At last, it summarizes the characteristics of Tang Law and its causes, and briefly explains the significance of its research.
