【摘要】：形成調(diào)整多式聯(lián)運的運輸規(guī)則是"一帶一路"戰(zhàn)略的合作重點之一,對此《鹿特丹規(guī)則》具有重要的借鑒意義。《鹿特丹規(guī)則》中對多式聯(lián)運的規(guī)定,第26條及第82條,從條文本身來看,不僅有損于規(guī)則的統(tǒng)一適用,而且從司法實踐的角度,會給締約國帶來困難或者并沒有多大意義。調(diào)整"一帶一路"戰(zhàn)略下海運加其他運輸方式多式聯(lián)運的運輸規(guī)則需要克服前述問題。而對《鹿特丹規(guī)則》第26條及第82條缺陷成因的分析,也為調(diào)整"一帶一路"戰(zhàn)略下其他類型多式聯(lián)運的運輸規(guī)則提供了借鑒。
[Abstract]:The formation and adjustment of transport rules for multimodal transport is one of the key points of cooperation in the strategy of "Belt and Road Initiative", which has important reference significance for the Rotterdam rules. Articles 26 and 82 of the provisions on multimodal transport in the Rotterdam rules, From the point of view of the provision itself, it not only undermines the uniform application of the rules, but also brings difficulties or does not make much sense to the State party from the perspective of judicial practice. Adjusting the transportation rules of shipping and other modes of transportation under the strategy of Belt and Road Initiative needs to overcome the above problems. The analysis of the causes of defects in Article 26 and Article 82 of the Rotterdam rules also provides a reference for adjusting the transport rules of other types of multimodal transport under the strategy of "Belt and Road Initiative".
