“一帶一路”多元爭(zhēng)端解決中心構(gòu)建的當(dāng)下與未來

【摘要】：我國(guó)國(guó)際爭(zhēng)端解決機(jī)制尚未在"一帶一路"沿線國(guó)間自然形成中心地位,構(gòu)建調(diào)解、仲裁、司法三位一體的"一帶一路"爭(zhēng)端解決中心應(yīng)從當(dāng)下和未來兩個(gè)層面進(jìn)行價(jià)值考量:調(diào)解、仲裁和司法三位一體模式的爭(zhēng)端解決中心是國(guó)家海外貿(mào)易及投資權(quán)益維護(hù)舉措的應(yīng)急與補(bǔ)缺;是推動(dòng)相關(guān)爭(zhēng)端爭(zhēng)端交由"一帶一路"沿線國(guó)家共同參與的爭(zhēng)端解決機(jī)構(gòu)進(jìn)行裁判的試驗(yàn)場(chǎng)。以此為近期目標(biāo),"一帶一路"爭(zhēng)端解決中心建設(shè)需要理性地接納境外仲裁機(jī)構(gòu)進(jìn)入中國(guó)并與中國(guó)爭(zhēng)端解決機(jī)構(gòu)合作;需要改變司法主權(quán)過度擴(kuò)張的觀念以促進(jìn)司法協(xié)助和合作;需要推進(jìn)調(diào)解機(jī)制的國(guó)際協(xié)調(diào)及"軟法規(guī)制"。"一帶一路"多元爭(zhēng)端解決中心的近期功能受制于沿線國(guó)的信任度以及當(dāng)事方的意思自治,而其承載的誠(chéng)信文化溝通、"一帶一路"區(qū)域仲裁機(jī)構(gòu)形成以及國(guó)際化人才培養(yǎng)的三大遠(yuǎn)期功能將是建設(shè)該中心的核心價(jià)值所在。
[Abstract]:China's international dispute settlement mechanism has not yet formed a central position naturally among the countries along "Belt and Road" to build mediation and arbitration. The judicial trinity of "Belt and Road" dispute settlement center should be from the present and the future two levels of value consideration: mediation, Arbitration and judicial trinity model of dispute settlement center is a national overseas trade and investment rights and interests protection initiatives emergency and fill the gap; It is a test ground to push the dispute to be adjudicated by the dispute settlement body of the countries along Belt and Road. As a short-term goal, the construction of "Belt and Road" dispute settlement center requires rational admission of overseas arbitration institutions into China and cooperation with Chinese dispute settlement bodies. There is a need to change the notion of excessive expansion of judicial sovereignty in order to promote mutual legal assistance and cooperation, and to promote international coordination and "soft regulation" of mediation mechanisms. " Belt and Road's recent functions are limited by the trust of the countries along the route and the autonomy of the parties concerned. The three long-term functions of the formation of Belt and Road regional arbitration institution and the training of international talents will be the core value of constructing the center.
