【摘要】：新時(shí)期國際恐怖主義愈演愈烈,ISIS的猖獗震驚了全世界。當(dāng)今的國際反恐法律機(jī)制缺乏一個(gè)統(tǒng)一為大多數(shù)國家所接受的定義,盡管國際社會(huì)反恐的法制在不同的層面都有所涉及,但是在實(shí)際操作和使用的過程中仍存在著重要的問題和適用的困境:聯(lián)合國現(xiàn)有反恐法律文件缺乏統(tǒng)一協(xié)調(diào)性,且存在很多空白和漏洞;反恐缺乏及時(shí)的信息來源,缺乏對(duì)稱性;區(qū)域性反恐法律機(jī)制面臨挑戰(zhàn)。所以發(fā)揮聯(lián)合國的主導(dǎo)作用,在維護(hù)世界的和平與發(fā)展,尊重當(dāng)事國的主權(quán),加強(qiáng)國際間的合作基礎(chǔ)上加速締結(jié)一個(gè)全面的普遍的國際恐怖主義公約已是國際反恐法制建設(shè)的必然趨勢(shì)。正在推進(jìn)"一帶一路"戰(zhàn)略的中國,隨著《反恐法》的出臺(tái),如何加強(qiáng)國際、區(qū)域的反恐合作機(jī)制建立及國內(nèi)相關(guān)法律機(jī)制建設(shè)和接軌,如何在必要時(shí)予以適當(dāng)?shù)能娛陆槿?同時(shí)提高全民的反恐意識(shí)是必要的風(fēng)險(xiǎn)應(yīng)對(duì)措施。
[Abstract]:The rise of international terrorism in the new era shocked the world with the rampant use of ISIS. Today's international legal regime against terrorism lacks a unified definition acceptable to most countries, even though the international community's counter-terrorism legal system is addressed at different levels. However, there are still important problems and difficulties in their application in practice and use: the lack of uniformity and coordination of the existing United Nations legal instruments against terrorism, as well as the existence of many gaps and loopholes; and the lack of timely sources of information on counter-terrorism. Lack of symmetry; regional counter-terrorism legal mechanisms face challenges. Therefore, the leading role of the United Nations is to safeguard world peace and development and to respect the sovereignty of the countries concerned. To accelerate the conclusion of a comprehensive and universal convention on international terrorism on the basis of strengthening international cooperation has become an inevitable trend in the construction of the international anti-terrorism legal system. China, which is promoting the "Belt and Road" strategy, with the promulgation of the Anti-Terrorism Law, How to strengthen the establishment of international and regional anti-terrorism cooperation mechanism and the construction and integration of domestic relevant legal mechanisms, how to intervene in military affairs when necessary, and how to raise the people's awareness of anti-terrorism are the necessary measures to deal with the risks.
