【摘要】：互惠原則是外國判決承認和執(zhí)行中的一項重要原則。由于該原則所具有的難以克服的缺陷,近年來,許多國家的立法明確廢除了該原則,或對該原則的適用施加了一定的限制或規(guī)定了例外條件。一些國家的法院在實踐中很少適用該原則,或在適用該原則時采用寬松、自由的解釋。我國法院一直以來都適用嚴格的正向互惠的做法,這不但與國際趨勢背道而馳,而且會使我國法院判決的承認和執(zhí)行面臨越來越孤立的境地,從而不利于中國與其他國家開展經(jīng)貿(mào)往來。為此,中國法院應考慮采用反向互惠制度,并通過建立報告制度以及設立信息資料庫為該制度的順利實施提供保障,為我國"走出去"戰(zhàn)略的實施和"一帶一路"倡議的推進創(chuàng)造有利的國際私法環(huán)境。
[Abstract]:The principle of reciprocity is an important principle in the recognition and enforcement of foreign judgements. Due to its insurmountable shortcomings, in recent years the legislation of many countries has expressly abolished it, Or imposes certain restrictions or provides for exceptions to the application of the principle... the courts of some countries rarely apply the principle in practice or are lenient in its application, Free interpretation. Our courts have always applied strict positive reciprocity, which not only runs counter to international trends, but also creates an increasingly isolated situation for the recognition and enforcement of our courts' judgements, For this reason, Chinese courts should consider adopting the system of reverse reciprocity and provide guarantees for the smooth implementation of the system by establishing a reporting system and setting up a database of information. To create a favorable environment of private international law for the implementation of China's "going out" strategy and the promotion of "Belt and Road" initiative.
